A RESOLUTION AUTHORIZING THE SIGNING OF A
CONTRACT, LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf of
the City of San Rafael, a contract, lease or agreement with
MODIFICATION TO JOINT POWERS AGREEMENT BETWEEN THE MARIN COUNTY
OPEN SPACE DISTRICT AND THE CITY OF SAN RAFAEL HE: ACQU1N1'1'lUN
OF SUN VALLEY OPEN SPACE (E%TENDING AGREEMENT AND MANAGEMENT
CLAUSE TO SEPTEMBER 30, 1985)
a copy of which is hereby attached and by this reference made a part
hereof.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly intro-
duced and adopted at a Regular meeting of the City Council of said
City held on Monday the 21st day of January
19 85 , by the following vote, to wit:

MODIFICATION TO JOINT POWERS AGREEMENT
THIS MODIFICATION made this 21st day of J anu ary , 1985 by
and between the MARIN COUNTY OPEN SPACE DISTRICT, a public district herein-
after referred to as "DISTRICT" and the CITY OF SAN RAFAEL, a municipal
corporation, hereinafter referred to as "CITY";
W I T N E S S E T H
The DISTRICT and CITY heretofore entered into a Joint Powers
Agreement, dated July 2, 1984, for the purpose of jointly purchasing certain
lands in the Sun Valley area of San Rafael; and
the term.
WHEREAS, the parties desire to modify said agreement by extending
NOW, THEREFORE, IT IS MUTUALLY AGREED as follows:
The term of this MODIFICATION TO JOINT POWERS AGREEMENT is hereby
extended for nine (9) months commencing January 1, 1985 and terminating
September 30, 1985, with the option of an extension hereto by either party
by giving thirty (30) days notice to the other party.
The DISTRICT shall manage the jointly acquired open space parcels
#177-240-14 and 20 until September 30, 1985, at which time the DISTRICT
and CITY shall meet and make arrangements for the proper management of
all lands within the San Rafael/Sleepy Hollow Divide open space area which
have been purchased by the DISTRICT and/or CITY. Management practices
and cost arrangements shall be as detailed in the Agreement of July 2,
1984.
Except as hereinabove amended, said Joint Powers Agreement
shall continue in full force and effect in all particulars.
IN WITNESS WHEREOF, DISTRICT and CITY have 'caused this
MODIFICATION TO JOINT POWERS AGREEMENT to be duly executed on the date
first above written.
