HomeMy WebLinkAboutCC Resolution 7030 (Occupancy Permit Requirements)RESOLUTION NO. 7030 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL ESTABLISHING AN ADMINISTRATIVE PRO- CEDURE IMPLEMENTING THE OCCUPANCY PERMIT REQUIRE- MENTS OF THE UNIFORM BUILDING CODE WHEREAS, the Uniform Building Code, Section 307, regarding certificates of occupancy, as amended by the San Rafael Municipal Code Section 12.12.020, establishes a procedure for the issuance of certificates of occupancy within the City; and WHEREAS, it is this City Council's desire to establish a more detailed procedure implementing the Uniform Building Code's certificate of compliance procedures; and WHEREAS, the City staff has prepared a detailed pro- cedure implementing the Uniform Building Code's certificate of occupancy procedure. NOW, THEREFORE, BE IT RESOLVED that the procedures out- lined in the attached Exhibit A be adopted within the City of San Rafael. BE IT FURTHER RESOLVED that the City staff may make minor amendments from time to time without bringing this issue back before the City Council. I, JEANNE M. APPLICATION: Applicant obtains application from the Building Division of the Department of Public Works and fills it out completely. (See instructions for completing application.) Application is submitted and inspection fee is paid. 2. INSPECTION: The Building Division disperses copies of the ap- lication to the various City Departments. Each Department, i.e., Police, Planning, Public Works and Fire, contacts the applicant during normal working hours, at the phone number the applicant has listed on the application and arranges an inspection. Results of the inspection are returned to the Building Division within fourteen (14) days of application. 3. NOTIFICATION: The Building Division will contact the applicant by mail and provide the results of the various inspections. 4. MAJOR VIOLATION: If a major zoning or code violation exists no occupancy permit will be issued. The applicant must make the necessary corrections and notify the appropriate depart- ment (s) for a reinspection. If the major violations are corrected either a Certificate of Occupancy or a Conditional Certificate of Occupancy will be issued. 5. MINOR VIOLATIONS: If a minor zoning or code violation exists a Conditional Occupancy permit may be issued. The Condi- tional Certificate of Occupancy shall constitute a warning citation under the infraction citation process. Conditional Occupancy permits will be issued for a reasonable period of time, not to exceed sixty (60) days. Conditional Certifi- cates of Occupancy shall be posted in a conspicuous place on the premises and shall not be removed except by the Building Official. If the corrections are made within the required time a Certificate of Use and Occupancy will be issued. If the corrections are not made within the required time limit an infraction citation may be issued. Additional citations may be issued as necessary. 6. NO VIOLATIONS: If no violations exist the applicant will be issued a Certificate of Use and Occupancy. The Certificate of Occupancy shall be posted in a conspicuous place on the premises and shall not be removed except by the Building official. 7. ISSUE BUSINESS LICENSE: When the applicant has received an Occupancy Permit he must obtain a business license from the Finance Department prior to opening for business. A business license will not be issued without a Certificate of Occupancy.
