A RESOLUTION DECLARING THE PUBLIC INTEREST RE-
QUIRES DISPENSING WITH THE FORMAL COMPETITIVE
BID PROCESS FOR THE REPAIR OF A PORTION OF THE
CITY OF SAN RAFAEL'S LEVEE ON SAN PEDRO ROAD
WHEREAS, this Council has reviewed the report of the Public Works
Director dated December 5, 1983 regarding the repair of the City's levee
on San Pedro Road; and
WHEREAS, when winter storm winds combine with the seasonal high
tides the water tops the levee and floods San Pedro Road making it im-
passable; and
WHEREAS, the City storm -drain system in that area does not include
an emergency back up source of power in the event the existing storm drain
pumps lose electrical power; and
WHEREAS, alternative access does not exist for this area of the City
because the road was washed out last year in the vicinity of China Camp;
WHEREAS, the combination of the above factors could render this area
of the City inaccessible by automobile.
NOW, THEREFORE, BE IT RESOLVED that this Council determines that
the public interest and necessity demand the immediate expenditure of
public money to safeguard the publicly owned levee on San Pedro Road and
to protect the public interest in the Peacock Gap area of San Rafael.
BE IT FURTHER RESOLVED that the City Manager is authorized to
execute on behalf of the City a contract for the repair of the levee
described in the Public Works Director's report dated December 5, 1983,
to the lowest responsible bidder after calling for informal bids from
at least five contractors capable of performing the work.

certify that the foregoing resolution was duly and regularly introduced
and adopted at a regular meeting of the Council of said City on Tuesday,
the 3rd day of January, 1984, by the following vote, to wit:
