HomeMy WebLinkAboutCC Resolution 6712 (MSS 13th Amendment)RESOLUTION N0. 6712 A RESOLUTION AUTHORIZING THE SIGNING OF A CONTRACT, LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael, a contract, lease or agreement with THIRTEENTH AMENDMENT TO AGREEMENT WITH MARIN SANITARY SERVICE a copy of which is hereby attached and by this reference made a part hereof. I, JEANNE M. LEONCINI, City Clerk TF?.TEENTH AMENDMENT TO AGREE NT The parties hereto are the CITY OF SAN RAFAEL, a municipal corporation organized and existing under and by virtue of the laws of the State of California, hereinafter referred to as "City" and MARIN SANITARY SERVICE, a California corporation, hereinafter re- ferred to as "Company". W I T N E S S E T H: WHEREAS, the parties have heretofore entered into a written agreement dated June 20, 1966 relating to the collection of all refuse from within the City, and have amended the same pur- suant to documents dated October 6, 1969, June 24, 1971, May 15, 1972, July 1, 1974, January 17, 1977, and January 2, 1979, January 21, 1980, October 6, 1980, July 6, 1981, August 16, 1982, January 17, 1983, and September 6, 1983; and WHEREAS, the parties now desire to further amend and modify said agreement in the respects hereinafter set forth; and WHEREAS, City has determined that said further amendment and modification is proper and in the best interests of its citizens: NOW, THEREFORE, it is mutually agreed that the written agreement between the parties dated June 20, 1966 and the amendments thereto dated October 6, 1969, June 24, 1971, May 15, 1972, July 1, 1974, January 17, 1977, January 2, 1979, January 21, 1980, October 6, 1980, July 6, 1981, August 16, 1982, January 17, 1983, and September 6, 1983 shall be and the same are hereby amended and modi- fied in the following manner: 1. The maximum schedule of rates and services as recited in section 3 at page 3 of the agreement dated June 20, 1966 and in the amendments heretofore mentioned are amended on each effective date to read as follows: Single-family Residential One 30 -gallon can Level areas Hill areas Two 30 -gallon cans Level areas Hill areas Effective January 1, 1984 (One Collection Per Week) $ 6.05 per month $ 7.00 per month (One Collection Per Week) $ 9.85 per month $11.30 per month (The aforementioned rates shall apply to cans located not more than one hundred (100) feet from the collec- tion vehicle. For any can located more than on hundred (100) feet, add $1.00 per can for each additional fifty JS;(50 ) feet or portion thereof.) Per agreement with customer, but not exceeding $6.05 per cubic yard. A 3% increase. Effective January 1, 1985 (One Collection Per Week) $ 6.25 per month $ 7.25 per month (One Collection Per Week) $10.20 per month $11.70 per month (The aforementioned rates shall apply to cans located not more than one hundred (100) feet from the collec- tion vehicle. For any can located more than on hundred (100) feet, add $1.05 per can for each additional fifty (50) feet or portion thereof.) Multiple Unit Residential All areas Commercial All areas All other services Same as Single-family resi- dential. Per agreement with customer, but not exceeding $6.25 per cubic yard. A 3.6% increase. 2. The rates and charges provided for herein shall be double for the collection of materials which have been compacted by mechanical, electrical, or hydraulic means. 3. If the Bay Area All Urban Consumer Price Index (October 1983 to October 1984) exceeds 5% then the Finance Director is authorized to return to Council to seek Council approval to increase the rates for 1985. - 2 - 4. Other than as specifically amended and modified, the aforesaid agreement between the parties dated June 20, 1966 and the aforesaid amendments thereto are hereby ratified and confirmed to be and continue in full force and effect.
