A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL DETERMINING THAT EAST SAN RAFAEL
TRAFFIC IMPROVEMENTS MUST BE MADE AND REQUIRING
PAYMENT OF PREVIOUSLY COVENANTED FEES
WHEREAS, the City Council of the City of San Rafael has
conducted an extensive study of the ultimate building and traffic
situation in East San Rafael; and
WHEREAS, the City Council found that there would be substantial
traffic improvements required by this ultimate building; and
WHEREAS, the City Council has required that various developers
record covenants or other security guaranteeing payment of their share
of the proposed traffic improvements at such time as the City Council
determined that the improvements were necessary.
NOW, THEREFORE, BE IT RESOLVED BY THE SAN RAFAEL CITY COUNCIL,
that the traffic improvements in East San Rafael are necessary at
this time and that the covenanted and otherwise secured traffic
mitigation fees are due and payable at this time and that all traffic
mitigation fees shall henceforth be due and payable at the time of
building permit issuance.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced
and adopted at a regular meeting of the Council of said City on Tuesday,
the 3rd day of January, 1984, by the following vote, to wit:
