A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL FORMALIZING CITY POLICY OF DISCOUR-
AGING THE SALE OF ALCOHOLIC BEVERAGES IN CON-
JUNCTION OR COMBINATION WITH VEHICLE FUEL SALES
WHEREAS, it has been a long-standing City practice to
discourage the sale of alcoholic beverages in conjunction or
combination with the sale of vehicle fuels; and
WHEREAS, the Police Department finds that the mixed
sale of alcoholic beverages with vehicle fuel uses increases the
incidence of drinking and driving; and
WHEREAS, the Police Department finds that many service
stations or commercial uses such as convenience stores employ
persons under the age of 21 as their regular employees. This
factor coupled with the fact that such uses generally become
gathering places for youthful drivers could cause increased
enforcement problems in controlling the sale of alcoholic beverages
to and/or by those under the age of 21; and
WHEREAS, in the past the City has denied Use Permits for
such mixed uses, primarily based on the above findings.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael City
Council formally discourages mixed uses involving the sale of
alcoholic beverages in conjunction or combination with the sale
of vehicle fuel.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
