HomeMy WebLinkAboutCC Resolution 6719 (Alcoholic Beverage Sales)RESOLUTION NO. 6719 A RESOLUTION OF THE SAN RAFAEL CITY COUNCIL DENYING UP83-72 TO ALLOW THE SALE OF ALCOHOLIC BEVERAGES FROM A GASOLINE SERVICE STATION LOCATED AT 1125 LINCOLN AVENUE WHEREAS, in August 1983 a use permit application was filed requesting alcoholic beverage sales from a gasoline service station; and WHEREAS, on September 7, 1983, the Zoning Administrator reviewed the use permit, denying the request because of the long- standing City practice of discouraging a mixture of such uses; and WHEREAS, an appeal was filed and reviewed by the Planning Commission on November 15, 1983, the Planning Commission voted (7-0) to refer the matter to the City Council to review the long-standing City practice of mixing sales of vehicle fuels with alcoholic beverages and to consider the use permit; and WHEREAS, on January 3, 1984, the City Council reviewed UP83-72 and made the following finding: Sales of convenience goods including alcohol on the subject site will under the circumstances of the particular case be detrimental on the health, safety, peace, morals, comfort and general welfare of persons in the neighborhood and the general welfare of the City, because of the following reasons: 1) The mixture of such uses at this location could increase the incidence of drinking and driving; 2) There are surrounding residential uses that would have to bear the noise and traffic effects of this use intensi- fication; 3) There are other liquor stores within reasonable dis- tance of this service station (Colonial Liquors on Tamalpais Avenue and Frank's Mini -Mart on Lincoln Avenue) that provide beer and wine sales; 4) Approval of the use permit would be precedent setting and it is likely that the City would receive numerous applications from other existing service stations; and - 1 - 6-7(5 RESOLUTION NO. 6 719 5) Other use permits involving the mixed sale of alcoholic beverages with vehicle fuel at other locations have been denied in the past based on long-standing City practice. NOW, THEREFORE, BE IT RESOLVED that the City Council denies UP83-72, a use permit, for the sale of alcoholic beverages from the gasoline/service station at 1125 Lincoln Avenue. I, JEANNE M.
