A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
AUTHORIZING FOURTH/AMENDMENT TO THE MAJOR CRIMES TASK FORCE
(Second)JOINT POWERS AGREEMENT
WHEREAS, Since 1979 the City of San Rafael, along with other
cities in Marin County, as well as the County of Marin, have entered
into a Joint Powers Agreement for the purpose of creating the Marin
County Major Crimes Task Force; and
WHEREAS, the constituency of the original signatories has changed
causing a need for restricting the Task Force operation in these non -
signatory jurisdictions; and
WHEREAS, the members of the Major Crimes Task Force Subcommittee
shall only be from jurisdictions participating in this agreement; and
WHEREAS, the City of San Rafael is now obligated to a financial
contribution of $42,806, which contribution shall be in lieu of man-
power members of the Major Crimes Task Force; and
WHEREAS, in order to effectuate the foregoing changes in the
Joint Powers Agreement creating the Major Crimes Task Force, it is
necessary for the City of San Rafael as a member jurisdiction to
execute the Fourth Amendment thereto.
NOW THEREFORE BE IT RESOLVED, by the City Council for the City
of San Rafael that the foregoing amendments to the Joint Powers Agree-
ment for the Major Crimes Task Force are hereby endorsed.
BE IT FURTHER RESOLVED That the Mayor and City Clerk of San

Rafael are authorized to execute the Fourth/Amendment to the Major
Crimes Task Force Joint Powers Agreement.

SECOND/ AMENDMENT
JOINT POWERS AGREEMENT
MARIN COUNTY MAJOR CRIMES TASK FORCE
RECITALS
1. The parties hereto previously entered into a Joint Powers
Agreement in August 1979, for the purpose of creating a Major
Crimes Task Force to combat major crime throughout the County
without regard to boundaries.
2. Said Agreement was thereafter amended in October 1981 for the
reasons therein set forth in said amendment.
3. The parties to the Joint Powers Agreement now desire to
execute this second amendment to said agreement as herein
below set forth because of the withdrawal or pending
withdrawal of several parties to same.
4. Now, therefore, it is agreed that the Marin County Major
Crimes Task Force Joint Powers Agreement is hereby amended,
effective October 1, 1983, as follows:
AGREEMENT
Section 3. C. is amended to read:
"3. C. The Task Force shall not initiate, operate, assist,
or serve municipalities in Marin County not signatory to
this agreement without the prior approval of the Oversite
Committee. Criteria for granting an exception may involve
a situation where an investigation commenced elsewhere
(which is the opinion of the Oversite Committee upon
recommendation of the unit commander) cannot otherwise be
concluded without crossing the boundaries of a non-
participating jurisdiction(s)."
Section 5. A. is amended to read:
115. A. Supervision of the Task Force shall be the Major
Crimes Task Force Subcommittee, hereafter called
Subcommittee, the membership of which shall be seven
members of the Chiefs' Association of Marin County, of
which the following shall be members: Sheriff of Marin
County, District Attorney of Marin County, President of the
Police Chiefs' Association, two of which shall be the
Chiefs of the largest jurisdictions, and two of which will
be selected at large from the remaining cities in the
County. All members must be from jurisdictions
participating in this agreement. The Liaison Chief of the
Subcommittee to oversee the everyday operation of the Task
Force will be chosen from these members. (Should the
President represent one of the three larger jurisdictions
mentioned above, the Subcommittee shall remain in size at
seven. The Chiefs at large will then increase from two to
three members.)"
Sections 7. B & 7. C. are amended to read:
"7. B. For fiscal year 1983-84, the Task Force budget and
the contribution of each party shall be as set forth in
Exhibit A, attached hereto and incorporated herein by
reference."
"7. C. Personnel assigned to the Task Force shall continue
to be employed and compensated by the assigning party,
subject to reimbursement for actual cost from Task Force
funds and at the rate designated for Task Force members."
Section 8. D. is deleted.
Section 9 is amended to read as follows:
" 9 . WITHDRAvyALS
It is agreed that the City of Novato has withdrawn as a
party to the Joint Powers Agreement, effective July 1,
1983.
6. The original Agreement of August 1, 1979, remains in full
force and effect, except as modified by the First Amendment
hereto and by this Second Amendment.
