HomeMy WebLinkAboutCC Resolution 6726 (Irwin St 13-Unit Residential Development)RESOLUTION NO. 6726 A RESOLUTION OF THE SAN RAFAEL CITY COUNCIL DENYING APPEAL OF PLANNING COMMISSION CONDITION (s) OF TS80-4 (TENTATIVE MAP) FOR THE IRWIN STREET 13 -UNIT RESIDENTIAL DEVELOPMENT; UPPER IRWIN STREET AT HAZEL COURT, AP 13-271-29 WHEREAS, on June 28th and November 29, 1983, the Planning Commission held public hearings to review the final EIR, zone change and tentative map for the proposed Irwin Street 13 -unit residential development; and WHEREAS, on November 29, 1983, the Planning Commission voted (7-0) to recommend that the City Council certify the Final EIR and adopt a zone change to P -D District. Additionally the Planning Commission conditionally approved a tentative map with the following condition (s): "(s) Buildings should be stepped down the hillside to minimize grading as well as building mass and bulk. Buildings shall be designed to a maximum height of 20 feet at any location from grade. Building design shall be subject to environmental and design review". WHEREAS, on December 12, 1983, the applicant appealed condition (s) of the tentative map approved by the Planning Commission; and WHEREAS, on January 16, 1984, the City Council held a public hearing and reviewed the appeal and made the following finding: The twenty foot building height limitation measured from a parallel line to grade is reasonable and encourages a building to be designed to step down a hillside. Such a regula- tion discourages a bulky and boxy building design that is generally more suitable for flat lot development. However, additional building heights up to 30' may be allowed provided that the Planning Commission finds that the building height would not create an adverse visual impact on the adjacent properties or the surrounding neighborhood. f NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council denies the appeal of condition (s) of the approved TS80-4 (tentative map) for the Irwin Street 13 -unit residential development, but revises the condition to read: (s) Buildings should be stepped down the hillside to minimize grading as well as mass and bulk. Buildings shall be designed to a maximum height of 20' at any location from grade. Building heights to 30' may be allowed provided that findings can be made that the additional height will not have an adverse visual impact on adjacent properties or the neighborhood. I, JEANNE M.
