HomeMy WebLinkAboutCC Resolution 6746 (260 Northgate I)RESOLUTION NO. 6746 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL (IN ITS CAPACITY AS BOARD OF APPEALS) DENYING APPEAL FROM STATE ACCESS REQUIREMENTS - 260 NORTHGATE I WHEREAS, the City Council of the City of San Rafael may serve as a Board of Appeals pursuant to Health and Safety Code Section 19957.5 to hear appeals from state mandated access requirements of said Code and of the Government Code; and WHEREAS, the applicant for 260 Northgate I has appealed said access requirements before the City Council, acting as the Board of Appeals; and WHEREAS, following a noticed hearing in which said applicant was given full opportunity to be heard, the City Council, acting as the Board of Appeals does hereby find as follows: 1. That the improvements occasioned by the proposed use have an estimated cost of approximately $8,000; 2. That the required accessible toilet room improvements have an estimated cost of approximately $1,460; 3. That the cost of the toilet room access improvements, in relation to the cost of the improvements, is modest, and does not render the entire project unfeasible; 4. That the required toilet room access requirements would not cause an unreasonable hardship. NOW, THEREFORE, BE IT RESOLVED BY THE SAN RAFAEL CITY COUNCIL, ACTING IN ITS CAPACITY AS BOARD OF APPEALS, that in view of the foregoing findings, the appeal for relief from access requirements for 260 Northgate I is not granted and the toilet room modifications shall be installed. I, JEANNE M.
