A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SAN RAFAEL SUPPORTING
THE EFFORTS OF THE COUNTY OF MARIN
REGARDING THE BERYL H. BUCK TRUST
WHEREAS, the San Francisco Foundation, acting as the
distribution committee of the Beryl H. Buck Trust, has filed a
petition for modification of the trust to permit use of some or all
of the trust funds outside of Marin County; and
WHEREAS, the provisions of the will of Beryl H. Buck
specifically provide that the beneficiaries of the Buck Trust are
the people of Marin County; and
WHEREAS, the County of Marin, as a party in the probate
proceedings, is vigorously opposing the petition of the San
Francisco Foundation and has filed a petition for the removal of
the San Francisco Foundation as a trustee of the Buck Trust; and
WHEREAS, the people of the City of San Rafael are benefi-
ciaries of the Buck Trust and have many unmet needs of a charitable
nature which may and ought to be supported by the Buck Trust.
NOW, THEREFORE, IT IS HEREBY ORDERED AND RESOLVED that
the City Council of the City of San Rafael supports the efforts of
the County of Marin and the Marin County Bar Association to defeat
the petition of the San Francisco Foundation for modification of
the Beryl H. Buck Trust, and supports the efforts of the County of
Marin to remove the San Francisco Foundation as trustee of the
Beryl H. Buck Trust.
IT IS FURTHER ORDERED AND RESOLVED that the City Attorney
is directed to monitor the progress of the litigation concerning
both petitions and to make such suggestions for the advancement of
the position of the People of San Rafael in the litigation, by
informal consultation with Counsel for the County of Marin and the
Marin County Bar Association, as he thinks appropriate.
IT IS FURTHER ORDERED AND RESOLVED that the City staff
is directed to compile a list of unmet needs in the City of San
Rafael which might appropriately be submitted to the trustees of
the Buck Trust, and to contact the other cities and towns in Marin

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the City Council
on Monday , the Fifth day of March , 1984, by
