HomeMy WebLinkAboutCC Resolution 6754 (Eliminate Shared Driveway Requirements)RESOLUTION NO. 67,' A RESOLUTION OF THE SAN RAFAEL CITY COUNCIL UPHOLDING APPEAL OF 1456 LINCOLN (UP80-59(b)) ELIMINATING SHARED DRIVEWAY REQUIREMENT WHEREAS, the owner of 1456 Lincoln Avenue applied for use permit and design review approvals to enlarge his office; and WHEREAS, City staff recommended a driveway consolidation with the adjacent parcel containing a 5 -unit apartment to provide a two-way driveway to both parcels rather than two 10 -foot wide driveways; and WHEREAS, the owner had significant concerns about the driveway consolidation for reasons of security and traffic and parking conflicts which the Planning Commission heard and addressed by modifying the conditions of approval to provide a one-year trial for the driveway consolidation; and WHEREAS, the applicant continued to be opposed to the driveway consolidation and wanted the same resolved, and there- fore appealed the decision to the City Council. NOW, THEREFORE, BE IT RESOLVED that the City Council upheld the appeal and eliminated condition (a) of UP80-59(b) due to concern about separation of uses and the proposed joint driveway's proximity to residences. The revised conditions of approval read as follows: (a) The property shall be paved to the property line, except for a narrow landscaping strip subject to Planning Director approval. (b) This use permit is valid for the use described at this location. I, JEANNE M.
