�4 THE CITY OF SAN RAFAEL CERTIFYING A
orq NEGATIVE DECLARATION FOR KERNER
U BOULEVARD ASSESSMENT DISTRICT AND
>, WETLANDS PLAN

WHEREAS, on June 21, 1982, the San Rafael City Council approved
U
the East San Rafael Wetlands Mitigation Plan with the intent to preserve
and enhance ponds and seasonal marshland areas and to allow filling of
a
w less environmentally sensitive wetlands in the East San Rafael area; and

WHEREAS, in June 1982, the San Rafael City Council certified

1° a Negative Declaration for the East San Rafael Wetlands Mitigation Plan;

'F:4 WHEREAS, said Plan encompasses approximately 60 to 65 acres of

P4 landfill, ponds, seasonal wetlands, with the land divided among many

aai Ln property owners; and
U WHEREAS, the Kerner Boulevard Assessment District is being formed

-H ro by these and other East San Rafael property owners to implement the wet -

- o lands plan and to construct other public improvements. Said Assessment

w;" District also includes roadway and service improvements consistent with
U the San Rafael Redevelopment Plan and the East San Rafael Wetlands
WO Mitigation Plan; and

O a WHEREAS, a Negative Declaration has been prepared for said

WHEREAS, on February 14, 1984, the Planning Commission recommended

E' to the City Council certification of a Negative Declaration and formation

� of Kerner Boulevard Assessment District consistent with the East San
H
N Rafael Wetlands Mitigation Plan; and
WHEREAS, said Assessment District improvements would implement
both the Wetlands Plan and Redevelopment Plan and would be consistent
with other previous approvals by the City and various State, Federal and
local agencies and organizations.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City
of San Rafael hereby certifies the Negative Declaration for Kerner
Boulevard Assessment District.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said
City on Monday, the 7th day of May, 1984, by the following vote, to
wit:
