RESOLUTION FINDING AND DETERMINING THAT THE PUBLIC
CONVENIENCE AND NECESSITY REQUIRE THE CONSTRUCTION OF THE
IMPROVEMENTS
CIVIC CENTER - NORTHGATE ASSESSMENT DISTRICT
The City Council of the City of San Rafael resolves:
A public hearing for which notice has been given by
publication, posting and mailing, has been held as to the public
convenience and necessity of the improvements in Civic
Center - Northgate Assessment District.
This Council has heard and considered all the evidence,
both oral and written, relative to the public convenience and
necessity of the construction of the improvements, and finds that
the public convenience and necessity require the following
improvements proposed to be constructed in Civic Center - Northgate
Assessment District.
Acquisition of capacity in Northgate Activity Center Plan
Traffic improvements, including: the proposed Merrydale
Road overcrossing of Highway 101 northbound on-ramp from
Manuel T. Freitas Parkway interchange, and other traffic
improvements proposed in the City of San Rafael Northgate
Activity Center Plan.
and further determines that the Special Assessment Investigation,
Limitation and Majority Protest Act of 1931 shall not apply to these
assessment proceedings and that this project shall proceed in
accordance with the terms and provisions of the Municipal
Improvement Act of 1913.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
California, hereby certify that the foregoing resolution was duly
and regularly introduced and adopted at a regular meeting of the
Council of said City held on the 18th day of June, 1984, by the
following vote, to wit:
