HomeMy WebLinkAboutCC Resolution 6852 (Peacock Gap Impr District)[PG -5] RESOLUTION NO. 6852 CITY OF SAN RAFAEL PEACOCK GAP IMPROVEMENT DISTRICT RESOLUTION APPROVING ENGINEER'S REPORT ON PROPOSED IMPROVEMENTS IN CITY OF SAN RAFAEL, PEACOCK GAP IMPROVEMENT DISTRICT, AND APPOINTING TIME AND PLACE FOR HEARING PROTESTS TO SAID IMPROVEMENTS AND CALLING FOR BIDS ON SAID IMPROVEMENTS WHEREAS, in accordance with prior proceedings duly had and taken, the City Council of the City of San Rafael (the "City") has declared its intention to and has determined to undertake proceedings pursuant to the Municipal Improvement Act of 1913 and issue bonds in said proceedings under the provisions of the Improvement Bond Act of 1915 for the acquisition and construction in the City of the public improvements more particularly described in Exhibit A, attached hereto and incorporated herein and made a part hereof, in and for an assessment district in the City designated Peacock Gap Improvement District; and WHEREAS, this City Council, by Resolution of Intention No. 6738 heretofore duly adopted on February 6, 1984, declared its intention to order said improvements to be made; and A WHEREAS, this City Council in and by said resolution referred said proposed improvements to the Director of Public Works of the City as Engineer of Work, and directed said Engineer of Work to make and file in writing a report containing the matters specified in Section 10204 of the Streets and Highways Code; and WHEREAS, in accordance with said resolution, said Engineer of Work has filed with the City Clerk of the City a report in writing containing the matters specified in said Section 10204 of the Streets and Highways Code; and WHEREAS, said report has been duly presented by the City Clerk of the City to this City Council for consideration and has been fully considered by this City Council; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Rafael, as follows: Section 1. The foregoing recitals are true and correct and this City Council so finds and determines. Section 2. Said report is hereby preliminarily approved by this City Council. Section 3. 8:00 o'clock P.M. on Monday, August 6, 1984, at the City Council Chambers, San Rafael City Hall, 1400 Fifth Avenue, San Rafael, California 94915, is hereby fixed as the time and place for hearing protests to said proposed improvements. Any interested person may object to said proposed improvements, the extent of the assessment district or to the proposed assessment by filing a written V protest with the City Clerk of the City at or before the time set for said hearing. Each protest must contain a description of the property in which the signer thereof is interested sufficient to identify the same and, if the signers are not shown on the last equalized assessment roll as the owners of such property, must contain or be accompanied by written evidence that such signers are the owners of such property. The City Clerk of the City shall endorse on each protest the date of its receipt and at said time appointed for said hearing shall present to this City Council all protests filed with her. Section 4. The City Clerk of the City is hereby directed (a) to cause notices of said hearing to be posted in the time, form and manner provided by law, and (b) to cause a notice of said hearing to be published in The Independent - Journal in the time, form and manner provided by law, and (c) to give notice by mail of the adoption of the Resolution of Intention for said proposed improvements and of the filing of said report to all persons owning real property proposed to be assessed in the time, form and manner provided by law. Section 5. Upon the completion of the mailing of said notices, the City Clerk of the City is hereby directed to file with this City Council an affidavit setting forth the time and manner of the compliance with the requirements of law for publishing, posting and mailing said notices. 3 Section 6. Mr. David M. Bernardi, Director of Public Works, City of San Rafael, San Rafael City Hall, 1400 Fifth Avenue, San Rafael, California 94915, telephone (415) 485-3355, is hereby designated to answer inquiries regarding the protest proceedings. Section 7. The City Clerk of the City is hereby directed to cause notices to bidders inviting sealed proposals or bids for the making of said improvements, in substantially the form attached hereto, marked "Exhibit B" and incorporated herein and made a part hereof, to be posted in three (3) public places in the City for two (2) succeeding weeks and to be published once a week for two (2) succeeding weeks in The Independent -Journal. Sealed bids for making said improvements shall be received at the time and place and in the manner specified in said notices. I, JEANNE M. V4 NOTICE INVITING SEALED BIDS Peacock Gap Water Tank Peacock Gap Improvement District The City Council of the City of San Rafael invites sealed bids for the construction of Marin Municipal Water District (MMWD) water system improve- ments in Peacock Gap Improvement District, City of San Rafael, Marin County, California. The improvements are generally described as follows: The construction of water system improvements within MMWD easements consisting of a 0.5 million gallon semi -buried reinforced concrete water tank, complete with inlet outlet valve structure, all appurtenant piping, supply pipeline, drainage facilities, and paved access road. Plans and specifications for the work may be obtained at the office of the Project Engineer - Murphy, Pulice, Associates, Inc., 3106 Fillmore Street, San Francisco, California 94123, upon deposit of $25.000 for each set. Said deposit is non-refundable. The contractor for the work will be required to pay the general pre- vailing rates of wages as determined by the Director of the Department of Industrial Relations of the State of California. A copy of these rates is on file with the City Clerk and is available on request. Bids must be accompanied by cash, a cashier's check or a certified check amounting to ten percent (10%) of the bid, payable to the order of the City Clerk or by bond for that amount signed by the bidder and two sur- eties (who shall justify before any officer competent to administer an oath, in double that amount, and over and above all statutory exemptions) or by a corporate surety bond to the satisfaction and approval of the Director of Public Works. The City Council reserves the right to reject all bids in its discre- tion, and to reject the bid of any bidder who has been delinquent or un- faithful in any former contract with the City. At that time, all bids will be publicly opened, examined and declared. The contract, if let, will be awarded to the lowest responsible bidder by the City Council at a subsequent time, but within the time set forth in the specifications. The contractor may elect to receive 100% of payments due under the contract from time to time, without retention of any portion of the payment by the City, by depositing securities of equivalent value with the City in accordance with the provisions of Section 4590 of the Government Code. The construction of all public portions of Peacock Manor and Pea- cock Estates including clearing, grading, subbase, base, pavement, curbs and gutters, storm drainage facilities, sanitary sewers and appurtenances; a system of domestic water supply including fire hy- drants, landscaping and all other improvements and facilities neces- sary for completion of the street improvements, and the acquisition of all necessary interests in real property. b. The improvements are gener- ally described as follows: The improvement of Point San Pedro Road/North San Pedro Road, includ- ing clearing, grading, subbase, base, pavement, curbs, gutters and side- walks, retaining walls, "wick" drains and subdrains, storm drainage facili- ties, force main sewer line; a system of domestic water supply and appur- tenances, and all other improvements and facilities necessary for comple- tion of the street improvements, and the acquisition of all necessary interests in real property. Point San Pedro Road is to be improved from the intersection with Riviera Drive in a northeasterly direction to the intersection with Cantera Way, where the name changes to North San Pedro Road, thence proceeding in a northerly direction to the intersection with Biscayne Drive.
