HomeMy WebLinkAboutCC Resolution 6858 (Marin Conservation Corps)RESOLUTION NO. 6858 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING THE SIGNING OF AN AGREEMENT WITH THE MARIN CONSERVATION CORPS THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as follows: The Mayor and City Clerk are authorized to execute, on behalf of the City of San Rafael, an agreement with the Marin Conservation Corps, a copy of which is attached hereto and incorporated herein by this reference. I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the Council of said City held on the 2nd day of July, 1984, by the following vote, to wit: AYES: COUNCILMEMBERS:Breiner, Frugoli, Nave, Russom & Mayor Mulryan NOES: COUNCILMEMBERS:None ABSENT: COUNCILMEMBERS: None lef JEAN M. Box 89, Saii Rafael, CA 94915 Agreement Between CITE' OF SAN RAFAEL and MARIN CONSERVATION CORPS THIS AGREEMENT made and entered into this 19th day of June, 1984, by and between the CITY OF SAN RAFAEL hereinafter referred to as 'City" and the MARIN CONSERVATION CORPS, hereinafter referred to as "Corps. IV WITNESSETH In consideration of the mutual promises and covenants hereinafter contained, the Parties hereto agree as follows: 1. Corps agrees to provide services to City as specified In Exhibit A, attached hereto and incorporated herein, in return for which services City agrees to pay Corps the sum of Fourteen Thousand Three " fired and Thirty -Six Dollars ($14,336.00). Such payment will be made as follows: 50%, $7168, upon commencement of work on June 25, 1984, 25%, $3584, on July 20, 1984, and 25%, $3584, on completion of work. 2. The Parties hereto hereby agree that Corps is an independent contractor and neither it nor any of its employees as contemplated hereunder shall be deemed for purposes of this Agreement, or for any purpose, as employees of the City. 3. The City and Corps agree that Corps is solely responsible for the recruiting, training, and supervision of its employees in the manner In which they perform the project. The City is entitled to a functioning and completed project as'outlined in Exhibit A. The control and supervision of the day-to-day performance of the work is vested with the Corps as agreed and directed by the City. 4. Corps agrees to indemnify, defend, and hold harmless the City, its agents, officers, and employees, from all claims, alleged liability, damages, suits, losses, costs, or expenses in law and equity (including costs of suit and expenses for legal services) arising out of bodily injury to or death of any person or damage to any property §'�'"'E` Exhibit A to Contract between City of San Rafael and Marin Conservation Corps 'ihe Marin Conservation Corps will provide a fully -supervised trails crew for the period of June 25 to August 17, 1984 as part of the MCL' summer program. Mork will consist of various projects in the City of San Rafael as directed by the City. Examples of typical projects would be: 1. Removal of brush behind Falkirk House for fire prevention. 2. Removal of brush in Boyd Park and 20' either side of the Boyd Hill Road for fire prevention. 3. Stream clearance in Miller Creek. 4. Brushing along Gold Hill Grade for fire vehicle access. 5. Brush removal and ditch drainage maintenance in Pickleweed Park. 6. Construction of picnic tables for Pickleweed Park. 7. Planting trees. The figure below includes supervision, transportation, tools, equipment, and coordination for the successful completion of projects outlined by the City. Budget Detail One supervised conservation crew, 32 days $14,336.00 Total cost to the City: $14,336.00 allegedly resulting from the operation of Corps or any of its employees under this agreement. In this connection, and without limitation to the foregoing, Corps agrees to procure and maintain on behalf of itself, the City, its officers, agents, and employees, insurance for liability during the term of this agreement in the amount of One Hundred Thousand Dollars ($100,000) bodily injury coverage for each person, and One Hundred Thousand Dollars property damage. Corps shall furnish proof of said coverage to the City prior to beginning work . 5. Corps further agrees to obtain and maintain 1n full force and effect during the term of this agreement worker's Compensation Insurance as is required by law and to furnish proof of said coverage to the City prior to beginning work. Further, the City shall be supplied with certificates of such insurance with the promise of Corps to notify the City at least twenty (20) days prior to the date of cancellation or lapse of said insurance. MUZIO, City Attorney RESOLUTION NO. 6857 RESOLUTION COMMENDING MARK SEDWAY ON APPOINT14ENT TO STATE BOARD OF EDUCATION WHEREAS, In June, 1984, Mark Sedway became the first student voting member of the California Board of Education; and WHEREAS, While attending San Rafael High School, Mark Sedway has amassed a lengthy record of student achievement and community service; and WHEREAS, In 1983 and 1984, Mark Sedway was one of the finalists for the San Rafael Centennial Youth Award for Community Service. NOW, THEREFORE, BE IT RESOLVED, that the San Rafael City Council, on behalf of the citizens of San Rafael, commends Mark Sedway for his dedicated public service to his community, and wishes him well in his new role on the State Board of Education.
