HomeMy WebLinkAboutCC Resolution 6862 (Smith Ranch Hills Marin)RESOLUTION N0. 6862 A RESOLUTION OF THE SAN RAFAEL CITY COUNCIL CERTIFYING PRIOR ENVIRONMENTAL IMPACT REPORTS FOR SMITH RANCH MASTER PLAN AMENDMENTS (Re: Smith Ranch Hills Marin) (Formerly known as: Gallinas Retirement Village) WHEREAS, pursuant to Title 14 of the San Rafael Muni- cipal Code, application has been received for amendment to the Smith Ranch Master Plan to revise the land use designation for areas currently depicted as Parcels 5 and 12 of Smith Ranch; and WHEREAS, the applicant has also requested adjustment of the public open space "Parcel C" to create a new building site for the relocation of the existing Las Gallinas Fitness Center/ Pool Club; and WHEREAS, City staff has prepared an Initial Environ- mental Study in accordance with State EIR Guidelines to assess the potential environmental impacts of the proposal; and WHEREAS, the certified Smith Ranch Master Plan EIR and the certified Northgate Activity Center Plan EIR also address potential impacts associated with development of the subject properties; and WHEREAS, the Planning Commission on February 28, 1984, held a duly noticed public hearing on the matter and heard all public testimony regarding the application; and WHEREAS, the Planning Commission found that the pro- posal would not create significant adverse impacts and recommended that the City Council certify that the project impacts were adequately addressed under the Smith Ranch Master Plan Environ- mental Impact Report, the Northgate Activity Center Plan Environ- mental Impact Report, and the project Initial Study; and WHEREAS, the City Council denied the proposal on April 2, 1984, but rescinded that decision on June 18, 1984, and directed the applicant to resubmit a revised proposal including an increased housing component for review by City staff and con- sideration at a duly noticed public hearing on July 2, 1984; and M_110����� RESOLUTION NO. 68„z WHEREAS, staff has prepared a revised initial environ- mental study for the revised submittal; and WHEREAS, the City Council concluded on July 7, 1984, that the project would not result in significant adverse impacts. NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council certifies that the project impacts associated with the requested Master Plan changes are adequately addressed under the Smith Ranch Master Plan Environmental Impact Report, the Northgate Activity Center Plan Environmental Impact Report, and the project Initial Study.
