A RESOLUTION AUTHO'.?IZING THE SIGNING OF A
MODIFICATION OF AGREEMENT
(RE: ABATEMENT OF EXCESS UNITS AT 405 "D" STREET)
THE CITY COUNCIL OF THE CITY OF SAN ??AFAEL RESOLVES AS FOLLOWS:
The MAYOR and CITY CLERK are authorized to execute, on
behalf of the City of San Rafael, a modification of that agree-
ment made b_v and between the Citv of San Rafael, Lawrence and
Nancv Loder and Harley and Jean Ussery, on December 6, 1982,
which modification is hereby attached and by this reference made
a part hereof.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a REGULAR

MODIFICATION OF AGREEMENT
The City of San Rafael and Lawrence and Nancy Loder
modify that Agreement made by and between the City of San
Rafael ("City"), and Lawrence and Nancy.Loder, and Harley
and Jean Ussery ("Owners"), on December 6, 1982, as follows:
WHEREAS, said Agreement provided that Owners would
abate, remove, or otherwise eliminate certain units claimed
to be excess by June 6, 1984; and
WHEREAS, Owners have in fact abated, removed, or
otherwise eliminated the excess units from the real
properties commonly known as 401 and 51.1 D Street, and one
excess unit at 405 D Street; and
WHEREAS, Owners have requested an extension of time for
the abatement of the second excess unit at 405 D Street for
the reason that the tenant of said unit will be vacating
said unit on or about August 1, 1984.
NOW, THEREFORE, the parties modify said Agreement
in the following manner:
Owners may have until September 1, 1984, to abate,
remove or otherwise eliminate the second illegal unit at 405
D Street.
Except as expressly modified herein, the Agreement
shall remain in full force and effect.
