HomeMy WebLinkAboutCC Resolution 6869 (Chevron Station Use Permit)RESOLUTION N0. 6869 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DENYING THE CHEVRON STATION USE PERMIT (UP84-37) 729 Fourth Street WHEREAS, the San Rafael City Council on July 16, 1984, considered a Use Permit application for replacement of the exist- ing Chevron self-service station at the southeast corner of Fourth and Lincoln with a new self -serve facility; and WHEREAS, the City Council concluded that a gasoline service station at this major entrance to downtown is not con- sistent with the spirit and intent of the San Rafael redevelopment plan or the recent recommendation of the Downtown Ad Hoc Retail Committee; and WHEREAS, the City Council concluded the property should eventually be redeveloped with uses more supportive of the Downtown retail core, and approval of the self -serve station Use Permit would decrease the likelihood of this happening. NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council denies the Use Permit application with the following findings: The use permit to remodel the existing service station use at Fourth and Lincoln into a self-service operation would be detrimental to existing pedestrian oriented retail uses and needed redevelopment of surrounding and vicinity properties in the San Rafael Downtown retail core for several reasons: 1. Allowing significant improvement of the site would decrease the likelihood of redevelopment to a more appropriate retail commercial or office use consistent with the urban form and pedestrian scale of downtown Fourth Street. 2. Service station layouts, particularly those for self-service stations, discourage pedestrian traffic and inter- rupt the predominant retail shop streetscape of Fourth Street with greater building setbacks and auto circulation areas in close proximity to pedestrian sidewalks. 3. Self-service auto uses add to traffic congestion, and Fourth Street has been designated primarily for traffic serving local retail uses. OItIGINAn., _ - e RESOLUTION NO. 6 9 I, JEANNE M.
