RESOLUTION APPROVING SECOND AMENDED ENGINEER'S REPORT
KERNER BOULEVARD ASSESSMENT DISTRICT
The City Council of the City of San Rafael resolves:
This Council has directed the Engineer of Work for the
Kerner Boulevard Assessment District to file a Second Amended
Engineer's Report pursuant to a settlement agreement between the
City of San Rafael and Raymond Piombo.
1. The Engineer of Work has filed the Second Amended
Engineer's Report as directed. By the terms of the Settlement
Agreement, Raymond Piombo has waived notice of the assessments,
hearing on those assessments, and the right to protest those
assessments, and has additionally waived his right to pay all or
any portion of those assessments in cash within 30 days of
their being levied.
2. This Council approves the Second Amended Engineer's
Report and each component part of it, including each exhibit incor-
porated by reference in the report.
3. This Council finds that the Engineer of Work, in
the Second Amended Engineer's Report has fairly and properly ap-
portioned the cost of the improvement to each parcel of land in
the assessment district in proportion to the estimated benefits
to be received by each parcel, respectively, from the improvement.
The Council hereby'confirms and levies each individual assessment as
stated in the Second Amended Engineer's Report.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
California, hereby certify that the foregoing resolution was duly
and regularly introduced and adopted at a regular meeting of the
Council of said City held on the 20th day of August, 1984, by the
following vote, to wit:
