HomeMy WebLinkAboutCC Resolution 6920 (Health Club)RESOLUTION NO. 6920 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL APPROVING USE PERMIT AND DESIGN REVIEW APPLICATIONS FOR A SECOND STORY ADDITION TO THE EXISTING NAUTILUS HEALTH CLUB AT 734 "A" STREET FILE NUMBERS UP83-64 & ED83-78 WHEREAS, in June 1983, the City received use permit and design review applications for a second story addition to the existing Nautilus Health Club at 734 "A" Street; and WHEREAS, staff reviewed the proposal concluding that the second floor addition meets current parking standards for gym- nasium ym-nasium uses; and WHEREAS, on March 13, 1984, the Planning Commission reviewed the project, questioning the proposed parking, grand- fathered parking and the City's parking standards. After lengthy discussion and public testimony, the item was continued for additional traffic and parking studies; and WHEREAS, following the Planning Commission meeting, the Planning Department and Nautilus staff met to discuss potential ways to provide remote parking and to improve street parking. Applicant was unable to secure remote parking but the City in- stalled street parking signs and curb painting along the west side of "A" Street adjacent to Safeway to control illegal street parking; and WHEREAS, on June 26, 1984, the Planning Commission reviewed the proposal and concurred with staff's recommendation to deny the proposal. The Planning Commission agreed that although the proposal meets current parking standards for gymnasium use, the new parking demand of this extremely successful health club business, if expanded as proposed, would be greater than the amount of new parking that is proposed; and WHEREAS, on August 2, 1984, a letter from Gary Ragghianti, Esq., representing the Nautilus Health Club was sub- mitted which questions how the Planning Commission could deny the proposed addition if it meets current code parking requirements and as a response to his concern staff has cited Section 14.13.190 of the Zoning Ordinance which authorizes the Planning Commission to approve parking requirements for uses not specifically mentioned RESOLUTION NO. 6_.20 in Section 14.13.100 through 170 of the Zoning Ordinance. By denying the proposal the Planning Commission did not approve the gymnasium parking standard recommended by staff. WHEREAS, on August 20, 1984, the City Council held a public hearing on the appeal. After discussing the proposal, it was determined that the appeal should be granted given that the proposal meets current parking standards for a gymnasium use. NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council approves the proposed project with the conditions listed in attached Exhibit 'A' and based on the following findings: UP83-64 The second story addition as proposed would not be detrimental to the health, safety & welfare of persons in the neighborhood or be detrimental to surrounding uses and properties or to the general welfare of the City in that the minimum on-site parking requirements for a gymnasium use would be met and that square footage limitations would be established for each use; and in that the parking demand is the result of the present lawful use of the property and not of the proposed second story addition. ED83-78 As modified by conditions of approval, this proposal would be consistent with criteria established for approving design review appli- cations. I, JEANNE M. LEONCINI, City Clerk 26 3 B/9 - 2 - EXHIBIT "A" CONDITIONS OF APPROVAL UP83-64 (a) This use permit for the Nautilus Health Club shall be approved with the frllcwin; uses and limitations: 1) First Floor Uses: a- 4,910 sq. ft. for weight lifting and Nautilus training equip.-,ent; b- 1,000 sq. ft. for the rac'retball court; c- 1,675 sq. ft. of locker room and showers; d- 250 sq. ft. for hdt tub; e- 1,915 sq. ft. for storage, lobby/reception. 2) Second Floor Uses: a- 2,070 sq. ft. for aerobics exercise room; b- 2,535 sq. ft. for locker roam and showers; • c- 420 sq. ft. for incidental office; d- 1,545 sq. ft. for hallsgays, corridors, storage. (b) All exterior alterations to the building shall be subject to indepen;ent design review approval. (c) A detailed schedule of aerobics exercise classes shall be submitted for Plan- ning Director approval prior to issuance of building permits. Aerobics exercise classes shall be scheduled with appropriate intervals between each class to avoid overlapping parking and locker room demand. (d) The Nautilus management shall periodically distribute information in the fern of a letter and map to all members (Exhibit A - example) indicating cermaitted and prohibited parking in the surrounding neighborhood with continued encourage- ment for members to use "the City parking lots, walk or bicycle to the faciiit;_ (e) All 11 on-site parking spaces must be made available to Nautilus members. (f) ;his use permit is approved for one year, or until August 20, 1985. Upon favorable review of the use and operation by the Zoning Administrator, a time extension may be granted. If parking problems arise at any time due to this addition, the use permit shall be referred to the Planning ComniSSiGn for revie,a and approval. ED83-78 (a) Prior to issuance of a building permit for the second floor addition, a detailed parking plan with landscaping/irrigation and bicycle racks shall be sub.itted for Planning Director approval. One parking space shall be eliminated to increase the amount of landscape area. (b) Prior to issuance of a building permit, the applicant shall submit a 55,000.00 bond or cash deposit to insure the completion of parking lot imprcve:.ents. The improvements shall be completed prior to occupancy of the second floor. (c) Proper directional signage (less than 5 sq. ft. for each sign) for parking sh::ll be installed at the entrance of the parking and at the "A" Street building entrance to make m�e.,bers a;;are of the available on-site parking. (d) This permit shall be approved for one year, or until August 20, 1985, and shall become null and void if a building permit is not issued or a tine extension granted.
