A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL AUTHORIZING THE MAYOR TO ACCEPT A
GRANT DEED FOR THE DEDICATION OF "COLEMAN'S
SPRING LOT" AS OPEN SPACE
WHEREAS, California Government Code Section 27281 re-
quires that deeds or grants conveying any interest in, or ease-
ment upon, real estate to a political corporation or governmental
agency for public purposes shall not be accepted for recordation
without the consent of the grantee evidenced by its certificate or
resolution of acceptance attached to or printed on the deed or
grant; and
WHEREAS, Section 27281 also states that a political
corporation or governmental agency, by a general resolution, may
authorize an officer or agent to accept and consent to such deeds
or grants.
NOW, THEREFORE, BE IT RESOLVED that the Council of the
City of San Rafael, California, does hereby authorize the Mayor of
the City of San Rafael to accept a grant deed for the dedication
of "Coleman's Spring Lot" (AP 15-250-03) to the City of San Rafael
and consent to the recordation thereof.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said
City on Tuesday , the 4th day of September 1984, by the
following vote, to wit:

EXHIBIT "A"
All that certain tract of land near the Town of San Rafael, Marin County,
California situated on the Westerly slope of the hill immediately
Northeasterly of the Lands of William Lichtenberg upon which tract hereby
conveyed is a certain spring and tunnel opening up said spring, particularly
bounded and described as follows:
BEGINNING at a point which is distant South 600 05' West 50 feet from
the mouth of the aforesaid tunnel; running thence North 290 55' West 50 feet
to a point; thence North 600 05' East 200 feet to a stake; thence South
290 55' East 100 feet to a stake; thence 600 05' West 200 feet to a stake;
thence North 290 55' West 50 feet to the point of beginning.
BEING the same parcel of land as described in that certain Deed from
Nevada Bank of San Francisco, a California Corporation to Henry D. Bacon,
recorded February 8, 1890 in Book 11 of Deeds at Page 258, Marin County
Records.
Reserving therefrom an exclusive perpetual easement for the use and enjoyment
of the spring, tunnel and waters of the spring and pipeline including the
right to enter upon the property to maintain the improvements thereupon
and construct such additional improvements as may be required to insure
the maximum flow of the spring waters.
Said Easement is for the benefit of and appurtenant to Lot A and Lot B as
shown on the parcel map - Lands of Anton F. Korbel, recorded
1984, Marin County Records, Instrument #
