HomeMy WebLinkAboutCC Resolution 6927 (Elementary School District Agr)RESOLUTION NO. 6927 A RESOLUTION AUTHORIZING THE SIGNING OF A CONTRACT, LEASE OR AGREEMENT AND REPEALIN-G RESOLUTION NO. 6924 ADOPTED SEPTEMBER 4, 1984 THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael, a contract, lease or agreement with (AMENDMENT TO)ASSISTANCE AGREEMENT BETWEEN THE CITY OF SAN RAFAEL AND THE SAN RAFAEL ELEMENTARY SCHOOL DISTRICT AND THE SAN RAFAEL HIGH SCHOOL DISTRICT a copy of which is hereby attached and by this reference made a part hereof. I, JEANNE M. LEONCINI, City Clerk 6 �2 7 ASSISTANCE AGREEMENT This agreement is made this 17tl7day of September 1984, by and between the City of San Rafael ("City") and the San Rafael Elementary School District and the San Rafael High School Districts ("Districts") with regard to the following facts: 1. Districts provide facilities and services within the City which services and facilities are of benefit to the residents of San Rafael; and 2. Districts, because of inadequate funding, have had difficulty maintaining some of the services and facilities provided to the residents of San Rafael; and 3. City desires to assist Districts in maintaining services and facilities in the City so as to provide benefits to the residents of San Rafael; THEREFORE, City and Districts agree as follows: 1. City agrees to undertake the work and provide the services described in the attached Exhibit A which work and services will benefit the City, Districts and the residents of San Rafael. 2. The term of this agreement shall be 20 years from the date of this agreement or the maturity of the bonds. Upon expiration of the term, none of the parties shall have any obligations to or rights against the other parties under this agreement. Attest fliba*nn-e—M. Mulryan, ayor SAN RAFAEL ELEMENTARY SCHOOL DISTRICT By 'l SAN RAFAEL HIGH SCHOOL DISTRICT 6 CJ �y l EXHIBIT "A" A PROPOSAL FOR A COOPERATION AGREEMENT BETWEEN THE CITY OF SAN RAFAEL AND THE SAN RAFAEL SCHOOL DISTRICT Purpose The purpose of this agreement is for the School District to amend the Redevelopment Agreement with the City to allow the sale of an additional $12 million in tax increment bonds and the City assist the School District with some of its present financial needs in areas where there is a mutual benefit to both the School District and the City. Proposed Actions by -the City: 1. To provide planning assistance and process support for devel- oping a site development plan for San Pedro School which meets School District, community and City needs. This proposal would include the City being responsible for developing some site planning options in concert with the School District, which would reflect a reasonable economic return for the District, retain the City's recreation inter- ests, and fit community design goals. The City would further facilitate the process for ultimate approval of the plan so the District has an approved plan for marketing to a developer. 2. To provide maintenance for the San Pedro and Davidson School fields, payment of water bills is included. 3. To develop a neighborhood plan, within two years for the Montecito neighborhood, to include San Rafael High School. Such plan would deal with future use of the high school site if choice is to close it. 4. To provide resurfacing of the tennis courts at San Rafael High School and Terra Linda High School at the rate of 3, 3, 4 courts per year in three years. 5. To work jointly with the School District to facilitate ped- estrian and bicycle safety for school children; said action to include installation of bike paths, in conformance with the Recreation Element. 6. To maintain one of the high school pools, the particular one to be determined by mutual agreement. If a high school is closed, the City would maintain the pool at the closed high school for community recreation use. Page two 7. To paint the exterior of Short School. S. The City will commit to working with the School District concerning additional parking at San Rafael High School if and when the decision is made to consolidate the high schools to San Rafael High School. Meanwhile, the City will work with the District to review the present parking layout and make recommendations for changes, the objective being to make the parking arrangement more efficient.
