HomeMy WebLinkAboutCC Resolution 6932 (1016 C Street Appeal)RESOLUTION NO. 69.32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL (IN ITS CAPACITY AS BOARD OF APPEALS) GRANTING APPEAL FROM STATE ACCESS REQUIREMENTS - 1016 "C" STREET. WHEREAS, the City Council of the City of San Rafael may serve as a Board of Appeals pursuant to Health and Safety Code Section 19957.5 to hear appeals from state mandated access requirements of said Code and of the Government Code; and WHEREAS, the applicant for 1016 "C" Street has appealed said access requirements before the City Council, acting as the Board of Appeals, and WHEREAS, following a noticed hearing in which said applicant was given full opportunity to be heard, the City Council, acting as the Board of appeals does hereby find as follows: 1. That the improvements occasioned by the proposed use have an estimated cost of approximately $7,000 to $10,000; 2. That the required accessible toilet room improvements have an estimated cost of approximately $10,000; 3. That the cost of complete access improvements, in relation to the cost of the improvements, is considerable, and renders the entire project unfeasible; 4. That the required complete access requirements would also cause an unreasonable hardship; 5. That the handicapped community does not feel complete toilet room improvements are warranted at this time; 6. That it is possible to provide a widened doorway to one toilet room and to install grab bars to make said toilet room accessible on a limited basis, without undue hardship. NOW, THEREFORE, BE IT RESOLVED BY THE SAN RAFAEL CITY COUNCIL, ACTING IN ITS CAPACITY AS BOARD OF APPEALS, that in view of the foregoing findings, the appeal for relief from complete access requirements for 1016 "C" Street be and is hereby granted, but that limited improvements be made. .4?�73 I, JEANNE M.
