The Planning Commission determined that there are special circumstances surrounding the properties in question that warrant approval of an exception to waive the dual annexation policy; and WHEREAS, on October 1, 1984, the City Councy reviewed the proposal concurring with the Planning Commission findings. NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council recommends that the Marin Local Agency Formation District approve an exception to waive the dual annexation policy for annexation to the San Rafael Sanitation District at 1, 5 & 7 Morgan Lane (Morgan Lane Annexation) based on the following findings: There are special and unusual circumstances surrounding the properties in question that warrant approval of an exception to waive the dual annexation policy. The current septic tanks serving these properties have the potential to create health problems to adjacent properties. Additionally, the slope of the properties is such that the most reasonable sewer connection to the RESOLUTION NO. 693u San Rafael Sanitation District will be through the Villa Real neighborhood, and that this will not change if annexation to the San Rafael Sanitation District occurs now or in the future (when, or if, Country Club annexation occurs). I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the Council of said City on Monday , the lst day of October , 1984, by the following vote, to wit: AYES: COUNCILMEMBERS: Breiner, Frugoli, Nave, Russom & Mayor Mulryan NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: None JEA M.
