A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL RECOMMENDING TO THE MARIN LOCAL AGENCY
FORMATION DISTRICT (LAFCo) THE APPROVAL OF AN
EXCEPTION TO WAIVE THE DUAL ANNEXATION POLICY FOR
ANNEXATION REQUESTS TO THE SAN RAFAEL SANITATION
DISTRICT AT 110 DEER PARK AVENUE, 240, 250 & 290
SEAVIEW AVENUE
WHEREAS, the Marin Local Agency Formation District has
received one proposal in unincorporated Country Club for annex-
ation to the San Rafael Sanitation District; and
WHEREAS, consistent with LAFCo policies, the proposal
was referred to the City of San Rafael for review and comment;
and
WHEREAS, on September 25, 1984, the Planning Commission
reviewed this referral and received public testimony. The
Planning Commission determined that there are special circum-
stances surrounding the properties in question that warrant
approval of an exception to waive the dual annexation policy;
and
WHEREAS, on October 1, 1984, the City Council reviewed
the proposal concurring with the Planning Commission findings.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael
City Council recommends that the Marin Local Agency Formation
District approve an exception to waive the dual annexation policy
for annexation to the San Rafael Sanitation District at 110 Deer
Park Avenue, and 240, 250 and 290 Seaview Avenue (Pigeon Hollow
Road Annexation) based on the following findings:
There are special and unusual circumstances
surrounding the properties in question that
warrant approval of an exception to waive the
dual annexation policy. Current septic systems
serving the properties in question are failing
and are in need of costly repairs, thus
potentially creating a health hazard to
adjacent properties.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said
City on Monday , the 1st day of October , 1984, by the
