HomeMy WebLinkAboutCC Resolution 6938 (City Attorney Vacancy)RESOLUTION NO. 6938 A RESOLUTION OF THE CITY COUNCIL OF SAN RAFAEL DECLARING THE OFFICE OF CITY ATTORNEY OF SAN RAFAEL VACANT EFFECTIVE SEPTEMBER 29, 1984 WHEREAS, on September 29, 1984, in a tragic mountain climbing accident, the City Attorney of San Rafael, Mr. Peter J. Muzio, was last seen falling into Hotlum Glacier located on Mount Shasta, California; and WHEREAS, the evidence contained in the attached Siskiyou County Sheriff's report of the incident overwhelmingly supports the conclusion that Mr. Muzio died on or about September 29, 1984. WHEREAS, the San Rafael City Charter, at Article 6, Section 7, provides that the office of City Attorney becomes vacant upon the death of the encumbent. NOW, THEREFORE, BE IT RESOLVED that based upon the evidence presented and made a part of the record, the San Rafael City Council finds that Mr. Muzio died on or about September 29, 1984 and declares his office vacant as of that date. LEONCINI, Clerk of the City of San Rafael hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a Special meeting of the City Council of the City of San Rafael on Tuesday , the Ninth day of October 1984, by the following vote, to wit: AYES: COUNCILMEMBERS: Breiner, Frugoli, Nave, Russom and Mayor Mulryan NOES: COUNCILI-EMBERS: None ABSENT: COUNCILMEMBERS:None JEANV M.
