HomeMy WebLinkAboutCC Resolution 6949 (Canalways Project)RESOLUTION NO. 6949 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT FOR THE CANALWAYS PROJECT WHEREAS, the City of San Rafael has received development applications for a General Plan Amendment, Urban Design and Development Policy Statement Amendment, and Rezoning for the 82.9 acre Canalways site which is located southeast of the intersection of Catalina Avenue and Bellam Boulevard; and WHEREAS, pursuant to the California Environmental Quality Act and City environmental assessment procedures, Planning Depart- ment staff completed an initial study for the proposed projects and found that there may be significant environmental impacts in wildlife habitat, water quality and sedimentation; and WHEREAS, a Draft Environmental Impact Report addressing those impacts was prepared and circulated for a 30 day public review period ending on April 4, 1983; and WHEREAS, the Planning Commission held a Public Hearing on the Draft EIR on April 8, 1983, to accept public testimony; and WHEREAS, responses to all comments were presented to the Planning Commission on June 14, 1983, at which time the Planning Commission requested that additional information be included in the Final EIR; and WHEREAS, an EIR supplement including the additional information was completed and circulated to the public on November 4, 1983; and WHEREAS, the Planning Commission on January 10, 1984, found that the EIR completely, correctly and adequately described the proposed project, significant environmental impacts which would result from the project, recommended mitigation measures and alternatives; and WHEREAS, the Planning Commission recommended to the City Council certification of the Final EIR; and WHEREAS, the San Rafael City Council held a public hearing on March 19, 1984, to review the EIR; and 0YUGTINAL -1- 001 RESOLUTION NO. 4 WHEREAS, in response to significant testimony about the need to expand the EIR the City Council directed staff to have the scope of the EIR expanded and recirculate the new EIR for public review; and WHEREAS, the new Draft EIR was prepared and circulated for a 45 day public review period ending on August 16, 1984; and WHEREAS, the San Rafael City Council conducted a public hearing to accept testimony regarding the adequacy of the EIR on August 20, 1984; and WHEREAS, responses to all comments received were reviewed by the City Council on October 15, 1984; and WHEREAS, the City Council finds that the EIR has been prepared in accordance with the California Environmental Quality Act. The EIR completely, correctly, and adequately describes the project, potential adverse impacts, mitigation measures, alter- natives to the project, public comments on the EIR and responses to those comments; and WHEREAS, the Final EIR will be reviewed by the decision making body and considered prior to acting on the project. NOW, THEREFORE, BE IT RESOLVED that the City Council certifies that the Final EIR is complete, correct and adequate in that it describes the project, potential adverse impacts, miti- gation measures, alternatives to the project, public comments on the EIR and responses to those comments.
