A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL DETERMINING THAT PRESERVATION OF CITY -
OWNED PROPERTY (AP 16-131-09) ON JUNIPERO SERRA
AVENUE FOR PUBLIC NEIGHBORHOOD OPEN SPACE IS
CONSISTENT WITH THE SAN RAFAEL GENERAL PLAN
WHEREAS, on April 16, 1984, the San Rafael City Council
reviewed a request from an adjacent property owner to purchase a
15,000 square foot City -owned parcel fronting Junipero Serra
Avenue and referred the matter to the Planning Commission to
determine if such a sale would be consistent with the San Rafael
General Plan; and
WHEREAS, on June 26, 1984, the Planning Commission
reviewed this referral, receiving information regarding potential
developability of the parcel and results of consultation with
other regulatory agencies. Given the amount of public testimony
received from adjacent residents, the Planning Commission continued
the matter so that neighborhood representatives could review the
proposal; and
WHEREAS, on August 20, 1984, staff held a meeting with
representatives of the Villa Real Homeowners Association who
request that the parcel be maintained in City ownership and
designated for open space; and
WHEREAS, on September 11, 1984, the Planning Commission
reviewed the proposal considering the site's open space signifi-
cance and comments from surrounding residents and recommending
that the parcel be maintained in City ownership for public open
space; and
WHEREAS, on October 15, 1984, the City Council
reviewed the proposal, but continued the matter at the request of
the optionee of the interested purchaser.
WHEREAS, on November 5, 1984, the City Council reviewed
the proposal and concurred with the Planning Commission conclusions.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael
City Council determines that the City -owned property fronting
Junipero Serra Avenue should be preserved as open space to be
consistent with the San Rafael General Plan based on the following
finding:

Preserving the property's open space value and
its status as a separator/divider between the
Villa Real and Country Club neighborhoods would
be consistent with General Plan Open Space
and Conservation Policies 7 and 8 which
encourage maintenance of open space that
serves as boundaries or delineators between
neighborhoods and preservation of hillsides
that provide pleasant visual backdrops.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said
City on Monday , the 5th day of November 1984, by the
following vote, to wit:
