HomeMy WebLinkAboutCC Resolution 6986 (Prospect Dr Retaining Wall)RESOLUTION NO. 6986 RESOLUTION DECLARING THE CONSTRUCTION OF A RETAINING WALL ADJACENT TO FAIR DRIVE TO BE AN EMERGENCY WHEREAS, the property owners located at A.P. No. 11-033-31 or more commonly known as 54 Fair Drive have filed a claim for damages against the City of San Rafael (City); and WHEREAS, through geotechnical analysis it has been determined that there is a high probability that additional damage to the residence located at 54 Fair Drive could occur if certain remedial work is not completed in a timely manner, namely the construction of a retaining wall below the house; and WHEREAS, the cost of said remedial work is estimated to be $35,000; and WHEREAS, the City Charter requires that any public works project exceeding $5,000 must conform to a formal public competitive bidding process; and WHEREAS, said competitive bidding process would take at least 45 days to implement; and WHEREAS, the City has been advised that said remedial work must be completed as soon as possible; NOW, THEREFORE, BE IT RESOLVED THAT THE SAN RAFAEL CITY COUNCIL finds that the public health, welfare and safety necessitates the waiver of the San Rafael Charter provisions for coopetitive bidding by declaring the construction of a retaining wall adjacent to 54 Fair Drive an emergency and directs City staff to proceed with construction of said wall with all possible dispatch. I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the Council of said City on Monday, the 3rd day of December, 1984, by the following vote, to wit: AYES: COUNCILMEMBERS:Breiner, Frugoli, Nave and Mayor Mulryan NOES: COUNCILMEMBERS:None ABSENT: COUNCILMEMBERS:Russom JE LEONCINI,'City Clerk ORIGINAL bq%e
