RESOLUTION DECLARING THE REPLACEMENT OF A
COLLAPSED 60 INCH STORM DRAIN LINE ADJACENT
TO 400 CANAL STREET PUMP STATION TO BE AN EMERGENCY
WHEREAS, City of San Rafael (City) maintenance forces have
discovered during the normal pursuit of maintenance duties that a
60 inch corrugated metal pipe adjacent to 400 Canal Street has
collapsed; and
WHEREAS, the collapsed pipe is preventing the free flow of
storm rainfall runoff; and
WHEREAS, if the pipe is not replaced, serious flooding will
occur, which includes potential damage to properties adjacent to and
served by this storm drainage facility; and
WHEREAS, it is estimated that the replacement of this pipe
will cost approximately $100,000; and
WHEREAS, the City Charter requires that all public works projects
exceeding $5,000 be subject to a formal competitive bidding process;
and
WHEREAS, serious damage to public and private property will
occur if this 60 inch pipe is not replaced immediately;
NOW, THEREFORE, BE IT RESOLVED BY THE SAN RAFAEL CITY COUNCIL
that it is in the public interest to waive the Charter requirements for
public competitive bidding to replace a collapsed 60 inch diameter
storm drain pipe adjacent to 400 Canal Street and declare the
replacement of said pipe to be an emergency.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said
City on Monday, the 3rd day of December, 1984, by the following vote,
to wit:
AYES: COUNCILMEMBERS: Breiner, Frugoli, Nave and Mayor Mulryan
NOES: COUNCILMEMBERS: None
