A RESOLUTION OF THE SAN RAFAEL CITY COUNCIL APPROVING AND
AUTHORIZING THE PUBLIC WORKS DIRECTOR TO AWARD MINOR
CONTRACTS IN AN AMOUNT LESS THAN ONE HUNDRED SEVENTY FIVE
THOUSAND DOLLARS ($175,000)
WHEREAS, Chapter 11.50 of the San Rafael Municipal Code generally mirrors the California
Public Contracts Code, which dictates the requirements for bidding and awarding municipal public works
projects; and
WHEREAS, both San Rafael’s Municipal Code and the California Public Contracts Code allow
the governing body of the public agency to delegate the authority to award informal, or minor contracts
to the Public Works Director up to a specific limit; and
WHEREAS, delegating the award of minor construction projects to the Public Works Director
saves time, minimizes administration cost and expedites the completion of smaller construction projects;
and
WHEREAS, San Rafael’s Municipal Code Section 11.50.020 G sets the City’s informal, or
minor contract limit at $125,000 and allows the minor contract amount to be modified by resolution of
the City Council; and
WHEREAS, the California Public Contracts Code section 22034 informal bid limit changes
from year to year depending upon the cost of construction and is currently set at $175,000; and
WHEREAS, City staff has recommended that the minor contract amount be increased to match
the Public Contracts Code amount.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
RESOLVES to increase the minor contract limit as defined in section 11.050.020 G to $175,000.
I, ESTHER C. BEIRNE, Clerk of the City of San Rafael, hereby certify that the foregoing
Resolution was duly and regularly introduced and adopted at a regular meeting of the City Council of
said City held on the Monday, the 20th day of November, 2017 by the following vote, to wit:
