Open the public hearing, accept public comment and deliberate; and 2. Pass ordinance to print (Attachment 1). BACKGROUND: In October 2015, Governor Brown signed Assembly Bill 1236 (AB 1236) enacting Government Code Section 65850.7. This new State law requires that cities and counties must establish procedures for expedited, streamlined processes for permitting electric vehicle (“EV”) charging systems. The intent of the law is to: a) remove unreasonable barriers to the installation of EV charging stations; b) not unreasonably restrict the ability of homeowners and businesses to install such systems; and c) promote and encourage the installation and increased use of EV charging stations. AB 1236 suggests that the local jurisdiction adopt a checklist of requirements with which a permit applica tion for an EV charging station is eligible for this expeditious review. The following is a summary of the other key provisions of this law: 1. The local jurisdiction shall administratively approve an application to install electric vehicle charging stations through the issuance of a building permit or similar nondiscretionary permit. 2. Review of the permit application by the Building Official shall be limited to the application meeting all health and safety requirements of the local, state and federal law. 3. Should the Building Official, in consultation with the Community Development Director, find that, based on substantial evidence, the application could have an adverse impact on public health and safety, the Building Official may require the applicant to apply for a Use Permit, which permit may not be denied unless the proposed installation would have a specific, adverse impact upon the public health or safety and there is no feasible method to satisfactorily mitigate SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 2 or avoid the specific, adverse impact. The law provides that the decision on the Use Permit may be appealed to the Planning Commission. 4. The State law does not prescribe a specific time frame or deadline for application action. Rather, the law requires that the local jurisdiction adopt a permit application checklist that details all the requirements to qualify for expedited review. For the expedited permit checklist, the State law suggests that the “Plug-in Electric Vehicle Infrastructure Permitting Checklist”1 be used as a basis for the local, expedited permit checklist. The model checklist provides the appropriate steps and specifications for permitting and installation. ANALYSIS: In response to AB 1236, a draft ordinance has been prepared and is attached (Attachment 1). The ordinance proposes to amend Title 12 (Building Regulations) of the San Rafael Municipal Code, specifically adding Chapter 12.25 (Expedited Permitting Process for Electric Vehicle Charging Stations). The content and format of the new municipal code text incorporates all the specific requirements and prerequisites set forth in the State law. However, the ordinance is drafted to follow the City’s municipal code requirements in the event a Use Permit is required for a specific application. The one unique provision presented in the code text is the requirement for a zoning review and clearance from the Planning Division for outdoor EV charging stations that are not attached to a building. Single-family residences would be exempt from this review. Separate from and in addition to the ordinance, application guidelines have been prepared to comply with the application checklist requirement of the State law (Attachment 2). The application guidelines will be posted on the City website. As proposed, the draft ordinance is consistent with the San Rafael General Plan 2020, specifically Sustainability Element Policies SU-3 (Alternative Fuel and Fuel-Efficient Vehicles) and SU-12 (Environmentally Beneficial Economy). Further, the draft ordinance is consistent with Climate Change Action Plan Program LF8 (Encourage ownership of plug-in vehicles). Please note that the City did not meet the State-prescribed deadline for adoption of this ordinance (September 30, 2016). However, in practice, the City has been providing expedited review for EV charging station applications, including over-the-counter, same day permits for most routine applications. ENVIRONMENTAL REVIEW: State law (California Environmental Quality Act- CEQA) requires that this project be reviewed to determine if a study of potential environmental effects is required. It has been determined that this project will not have a significant effect on the environment and no environmental review will be completed. This project is exempt from the provisions of the California Environmental Quality Act Guidelines under 14 CCR Section 15061(b)(3) (general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment). COMMUNITY OUTREACH: As the proposed action is the adoption of an ordinance to the San Rafael Municipal Code, a public hearing is required. Notice of the public hearing was published in the Marin Independent Journal. A copy of the published notice is attached (Attachment 3). In addition, Sustainable San Rafael, the Marin Builders Association and the San Rafael Chamber of Commerce were notified by mail. 1 Source: “Zero-Emission Vehicles in California- Community Readiness Guidebook,” OPR. SAN RAFAEL CITY COUNCIL AGENDA REPORT / Page: 3 FISCAL IMPACT: The adoption of this ordinance has no new fiscal impact on the City and no changes to the City’s Master Fee Schedule are proposed. EV charging stations are subject to an electrical permit, which is a flat fee of $125.00 per application. A building permit and accompanying plans are required all non- residential projects. The building permit fee is based on the valuation of the improvements. The adoption of this ordinance will provide for more streamlined review of applications for EV charging stations but will not result in any changes in the actual or projected revenue that is generated for these applications. OPTIONS: The City Council has the following options to consider on this matter: 1. Pass ordinance to print as recommended by staff: 2. Pass ordinance to print with modifications; 3. Public Hearing Notice ORDINANCE NO. 1954 AN ORDINANCE OF THE CITY OF SAN RAFAEL AMENDING TITLE 12 OF THE SAN RAFAEL MUNICIPAL CODE ("BUILDING REGULATIONS") TO ADD NEW CHAPTER 12.25 ESTABLISHING AN EXPEDITED PERMITTING PROCESS FOR ELECTRIC VEHICLE ("EV") CHARGING STATIONS WHEREAS, the State of California and the City of San Rafael have consistently promoted and encouraged the use of fuel-efficient electric vehicles; and WHEREAS, in 2015, the State Legislature adopted Assembly Bill 1236, (enacted as California Government Code Section 65850.7) which requires local agencies to adopt an ordinance creating an expedited and streamlined permitting process for electric vehicle charging systems; and WHEREAS, creation of an expedited, streamlined permitting process for electric vehicle charging stations would facilitate convenient charging of electric vehicles and help reduce the City's reliance on environmentally damaging fossil fuels; NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES FIND AND ORDAIN AS FOLLOWS: DIVISION 1. CEQA EXEMPTION. The City Council hereby finds that the adoption of this ordinance is exempt from the requirements of the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines (California Code of Regulations, Title 14, Chapter 3, Sections 15268 and 15061 (B)(3) because these regulatory procedures are part of the ministerial building permit process, adopting standard codes in effect pursuant to state law and setting requirements for compliance. The adoption of this ordinance does not entitle new development or any changes to the physical environment, so it can be determined with certainty that there is no possibility that the proposed amendments will have a significant effect on the environment. DIVISION 2. AMENDMENTS. San Rafael Municipal Code Title 12 (Building Regulations) is hereby amended to add new Chapter 12.25 ("Expedited Permit Process for Electric Vehicle Charging Systems") as follows: Chapter 12.25 -EXPEDITED PERMITTING PROCESS FOR ELECTRIC VEHICLE CHARGING STATIONS 12.25.010 -Purpose. The purpose of this Chapter is to promote and encourage the use of electric vehicles by creating an expedited, streamlined permitting process for electric vehicle charging stations while promoting public health and safety and preventing specific adverse impacts due to the installation and use of such charging stations. This Chapter implements California Government Code Section 65850.7. 1 12.25.020 -Definitions. For purposes of this section, the following definitions shall apply: (a) "Electric vehicle charging station" or "charging station" means any level of electric vehicle supply equipment station that is designed and built and installed in compliance with Article 625 and other general requirements of the California Electrical Code in effect at the time of installation, and delivers electricity from a source outside an electric vehicle into a plug-in electric vehicle. (b) "Specific, adverse impact" means a significant, quantifiable, direct, and unavoidable impact, based on objective, identified, and written public health or safety standards, policies, or condition as they existed on the date the application was deemed complete. (c) "Electronic submittal" means the utilization of one or more of the following: electronic mail or email, the internet, or facsimile. (d) A "feasible method to satisfactorily mitigate or avoid the specific adverse impact" includes, but is not limited to, any cost-effective method, condition, or mitigation imposed on an application for a permit. 12.25.030 -Expedited Permit Process. The chief building official shall develop, maintain and administer an application checklist of all requirements for which electric vehicle charging stations shall comply in order to be eligible for expedited review. The application checklist shall be published and made available on the city website. The checklist shall include information on how and where to file an application including instructions for electronic submittal, necessary worksheet, and an application form. 12.25.040 -Permit Application Processing. The city building division shall make every attempt to review and approve for permit issuance all applications for electric vehicle charging stations in an expedited fashion when completed applications are received which meet all the requirements of the application checklist, as follows: (a) The city shall administratively approve an application to install an electric vehicle charging station through the issuance of a building permit or similar nondiscretionary permit. (b) For outdoor electric vehicle charging stations that are not attached to a building, zoning review and clearance from the planning division shall be required prior to the issuance of a building permit or similar nondiscretionary permit. Single-family residences are exempt from this zoning review and clearance. (c) Review of the application to install an electric vehicle charging station shall be limited to the chief building official's review of whether the application meets all health and safety requirements of local, state, federal law, and the local utility authority. The requirements of local law shall be limited to those standards and regulations necessary to ensure that the electric vehicle charging station will not have a specific, adverse impact upon the public health or safety. (d) Upon city confirmation that the application and supporting documents are complete and meet the requirements of the federal, state and local codes, the city shall approve the application and issue all required permits or authorizations. (e) In the event the application and supporting documents are incomplete, the city shall issue a written correction notice to the applicant detailing all deficiencies in the application and list any additional information required to be eligible for expedited permit issuance. (f) In the event the chief building official, in consultation with the community development director, makes a finding, based on substantial evidence, that the electric vehicle 2 charging station could have a specific, adverse impact upon the public health or safety, the city may require the applicant to apply for a use permit, which shall be subject to the following: (1) An application for a use permit shall be filed and processed pursuant to title 14 (zoning) of this code. The city zoning administrator shall conduct the required public hearing and take action on the use permit application. (2) The zoning administrator may not deny an application for a use permit to install an electric vehicle charging station unless it makes written findings based upon substantial evidence in the record, that the proposed installation would have a specific, adverse impact upon the public health or safety, and there is no feasible method to satisfactorily mitigate or avoid the specific, adverse impact. The findings shall include the basis for the rejection of potential feasible alternatives of preventing the adverse impact. (3) Any conditions imposed on a use permit application shall be crafted to mitigate the specific, adverse impact upon the public health or safety at the lowest cost possible. (4) The zoning administrator's decision on the use permit may be appealed to the planning commission pursuant to the time limits and processing provisions set forth in title 14 (zoning) of this code. 12.25.050 -Fees. Fees for permits subject to this application process shall be as set forth in the master fee schedule resolution of the city council, as amended from time to time. DIVISION 3. SEVERABILITY. If any subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this added ordinance section. DIVISION 4. PUBLICATION: EFFECTIVE DATE. A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the office of the City Clerk at least five (5) days prior to the Council meeting at which it is adopted. This ordinance shall be in full force and effect thirty (30) days after its final passage, and the summary of this ordinance shall be published with fifteen (15) days after the adoption, together with the names of those Councilmembers voting for or against same, in the Marin Independent Journal, a newspaper of the general circulation published and circulated in the City of San Rafael, County of Marin, State of California. LINDSA Y LARA, Interim City Clerk 4 EXHIBIT 2 Draft Checklist/Application + Informational Handouts -Residential Guide for Electric Vehicle (EV) Charger Installation SAN RAFAEL THE CITY WITH A MISSION RESIDENTIAL GUIDELINE FOR ELECTRICAL VEHICLE (EV) CHARGER INSTALLATION The purpose of this guideline is to assist homeowners and contractors in streamlining the permitting and installation process for residential EV Charging Stations Introduction: There are 2 basic types of EV chargers for home use (Levelland Level 2). Levell chargers are smaller units that plug directly into a standard 120 volt receptacle outlet. These types of chargers typically require a longer period of time to recharge the vehicle. As long as the receptacle outlet being used to plug in the Level 1 charger already exists, there is no requirement to secure a permit from the Building and Safety Division. On the other hand, if you will be installing a new 120 volt receptacle outlet for the charger, you will need to obtain a permit -but you will not need to provide any plans or electrical load calculations as would be required for the more powerful Level 2 type charging systems. A Level 2 EV charging system requires 240 volts and charges the vehicle much faster than a Levell charger. Level 2 charger installations require a permit from the City. In order to obtain the permit, you will need to provide the City with some basic information, and demonstrate that your existing electrical service can handle the added load. If a service upgrade is necessary, that additional scope can be added to the electrical permit for your EV charger. When installing your EV Charger, be sure to use a licensed Electrical Contactor whose license is current. The Contactor shall follow the guidelines of the manufacturer and all necessary Code requirements. AC Levell slow charging (120 volts, lS!20amp) Standard wall outlet charging, typically comes with the car; slowest but simplest charging. AC Level 2 medium charging (208 -240 volts, max 80amps) Level 2 requires a dedicated circuit and may require an electrical panel upgrade. Information that is needed by the City, in order to obtain the permit: The City of San Rafael has developed this "EV" Charger Installation Guideline" in order to streamline the permit and installation process. In most cases, you or your contractor merely need to fill-in the blanks on these documents, provide a site plan and/or floor plan, attach the manufacturer's installation instructions and Charger specifications, and submit it to the Building Division for an expedited review and permit issuance. Or you may complete the application online and submit it electronically. If all of the required information is provided, and the proposal complies with the applicable codes, the review and approval process will be very brief. Once the permit is issued, the installation may begin. During the installation, inspection(s) will need to be scheduled in order for a City inspector to approve the work performed. The inspection request will need to be scheduled through the San Rafael Building Division's automated inspections line, and is typically scheduled by the customer or their electrician. Inspections are typically performed on the next regular work day following your request for inspection. Please keep in mind that someone will need to be present during the inspection so that the Building Inspector can access the location of the EV Charger, which is typically located in the garage. Panels and service outlets will need to be open for inspection. Contact your electric utility provider: PG&E can help determine the best meter & rate options for you PEV. Several options are available: • Keep your existing PG&E billing plan and pay your existing rate for the PEV electricity that you consume on you existing bill. • Choose a whole house rate for a shared EV-A meter with time-of use (TOU) billing rate for both the house and the PEV. TOU charging offers a lower rate for charging at night compared to the day. Requires a SmartMeter. • Choose a separate EV-8 meter to install a dedicated time-of-use (TOU) meter just for your PEV. TOU charging offers a lower rate for charging at night compared to the day. Note: Property owners are required to record a "Notice of Limitation on Use of Property" with the Marin County Clerk-Recorder for submittal with the electrical permit application. Initial Steps: 1. Research car & get the charging specifications from the manufacturer. 2. Verify that the car will fit completely on your property while charging. Must be clear of sidewalk . 3. Have your electrical system assessed by a licensed electrician for capacity and to determine if up-grades are needed. For safety reasons, it may be required to have a dedicated circuit for Type 1 PEV charging. If service size is too small, a service upgrade may be required. 4. Apply for permits with City of San Rafael. .An electrical permit is required for all residential PEV charging systems when electrical work is needed. A zoning permit (Zoning Certificate) may be required for outdoor installations. 6. Obtain a Rough-in & final inspection from City of San Rafael Building Division as permitted work proceeds. Permitting Requirements for Residential PEV Charging Systems: An electrical permit is required for single family residential PEV charging systems when electrical work is needed to install the equipment. A mechanical permit will be required if the manufacture's installation guidelines require mechanical ventilation. When attached to the side of a building, the charging system must be at least 3' from the property line. Approval of PEV charging system location does not change the required legal off-street parking requirements. A Zoning Certificate is required for outdoor PEV charging systems installations that are not attached to a building, and may be required for other outdoor locations if the space where a car will charge is less than 8' x 18'. A charging car or charger component cannot be in the public right of way (i.e. over a sidewalk or at a curb). Permit Application Submittal Requirements: Applicants must submit four (3) sets of legible plans (minimum 11"x17"L drawn to scale, and fully dimensioned, with the following information: • Application form with project address, owner name, address, phone, and a brief description of project; • Site plan with property lines, garage or parking space dimensions & clearances of proposed charging system location including location of additional meter, if applicable; • Floor plan and electrical plan for garage or carport where charger will be located; • Size (height, width and depth) of charging system, with a single line electrical plan; • Type of charging system: Levell/Level 2, with approved product listing agency (Le., UL) number; • Manufacturer's specifications, installation guidelines, and, if applicable, ventilation requirements; • For all Level 2 Chargers -existing panel rating, proposed charging load & whole house load calculations; • If installing an EV-B meter, meter must be labeled as "PEV Charging only" Application Submittal: You may submit your application in person at the Building Division counter M-Th, 8:30 to 4:30 and Friday 8:30 -1:30. OR You can submit your application via email to the following email account: building@cityofsanrafael,org Permit Fees: PEV charging systems for single family homes require only a basic electrical permit (minimum fee) and are subject to hourly plan check fees. In other than single family homes, an outdoor installation will require a building permit fees, plan review fees, and may involve necessary parking space striping and signage, and also be subject to a standard Zoning Certificate review and fee. Inspection: For single family home installations, only a final inspection is required; however a qualified person must be present to remove panel covers or expose wiring if needed. For commercial installations, other types of inspections may be required based on the scope of work, such as trench inspection or rough electrical inspection. DSA/s Access Compliance jurisdiction encompasses state-funded buildings, facilities and universities, as well as publicly-funded elementary schools, secondary schools, and community colleges. Local jurisdictions mayor may not adopt similar methods of administering current code requirements, determining equivalent facilita- tion/ or defining acceptable parameters as necessary in enforcing the existing California Building Standards Code as allowed under Government Code Section 4451 (f)] of the California Code of Regulations . Issue: In state funded projects with electrical vehicle, charging stations must be accessible. Electric Vehicles are being slowly introduced to the consumer market over the next three years as a result of an agreement between auto makers and the State of California. The zero emission vehicles as well as the equipment to charge them are continuing to develop and change at a rapid pace. Yetto successfully serve new electric vehicle customers, public charging is essential. Public charging sites that are developed now are likely to see signifi- cant technology changes before electric vehicles are fully commercialized. Based on a rule adopted by the California Air Resources Board, beginning in 2003, 10 % of vehicles sold in California must be zero emission. Public charging stations will be installed in public places such as shopping centers, parking lots and garages of companies or municipalities. They are provided as a convenient charg- ing location for Electric Vehicle owners while they work or shop. Full charging of an Electric Vehicle takes between two to three hours. Resolution: Representatives of the Division of State Architect, California Electric Transpor- tation Coalition, Edison EV, The California Building Officials, Department of Rehabilitation and members of the disabled community have held meetings for the purpose of developing interim guidelines to address the issue of disabled access to these charging stations. The following guidelines have been developed and agreed upon by the these organizations: ARE EV CHARGING STATIONS REQUIRED TO BE ACCESSIBLE? Yes. EV Charging Stations are required to be accessible because they offer a service to the general public. When EV charging is coupled with regular parking, the EV charging is con- sidered the primary service. (See Item V for further discussions.) An information sign must be posted which reads, "Parking for EV Charging Only; This Space Designed for Disabled Access; Use Last." MUST ACCESSIBLE EV CHARGING STATIONS BE RESERVED EXCLUSIVELY FOR THE USE OF PERSONS WITH DISABILITIES? No. The primary function of these stations is the charging of Electric Vehicles. Parking is not intended to be the primary use of the charging station. ARE THERE ANY RESTRICTIONS RELATIVE TO THE LOCATION OF THE ACCESSIBLE EV CHARGING STATIONS? For installations associated with new construction, the accessible charging station must be located in close proximity to a major facility, public way or a major path of travel on the site. Note: 200 feet is the maximum distance recommended. However, the charging stations need not be provided immediately adjacent to the major facilities since, again, the primary purpose of the stations is to provide the charging as a service , and parking is not intended to be the primary use of the stations. For installations at existing sites, the accessible charging station need not be located in close proximity to other services at the site. IS AN ACCESSIBLE PATH OF TRAVEL REQUIRED FROM THE ACCESSIBLE EV CHARG- ING STATION TO OTHER SERVICES PROVIDED AT THE SITE? Yes, for installations associated with new construction. As for other facilities on the site, an accessible path of travel is required between facilities. For installation at an existing site, an accessible path of travel is required to the extent that the cost of providing such path does not exceed 20% of the cost of the EV equipment and installation of all EV charging stations at the site, when such valuation does not exceed the threshold amount referenced in Exception 1 of Section 1134 of Title 24. The accessible path of travel shall connect to a major facility, public way or major path of travel on the site. The valuation of other improvements at the site over the last three years need not be added to the cost of the installation to determine application of the exception referenced in item VI above.
