A RESOLUTION OF THE SAN RAFAEL CITY COUNCIL
CONDITIONALLY APPROVING CC81-19: CERTIFICATE
OF COMPLIANCE FOR 347 PROSPECT DRIVE
WHEREAS, the applicant P. G. Duryee requested approval
of a Certificate of Compliance to recognize AP 11-033-40
(347 Prospect Drive) as a legal buildable lot.
WHEREAS, the Planning Commission on January 5, 1982
denied said certificate with findings that the parcel did not
meet the code provisions which were in effect at the time the
property was illegally subdivided.
WHEREAS, the matter was appeal to the City Council on
February 16, 1982, and the Council determined that the Certificate
should be issued if the property could be reasonably developed
without adversely affecting adjacent or vicinity properties and
improvements.
WHEREAS, the City Council referred the proposed resi-
dence back to the Planning Commission for review.
WHEREAS, the Planning Commission concluded that, as
modified by recommended conditions, the proposed residence could
be safely developed without significant adverse impacts.
WHEREAS, the City Council on March 21, 1983 held a
duly noticed hearing on the matter and concurred with the Planning
Commission recommendation to issue the Certificate.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael
City Council approve a Certificate of Compliance for the lot pur-
suant to specified conditions and with the following findings of
fact.
Findings: Development of the property as modified by
the conditions of approval will not represent a significant
adverse effect on public health and safety. Geotechnical,
drainage, sight distance, and privacy concerns have been ade-
quately reviewed and addressed in the recommended conditions of
approval. The residence can be developed within the applicable
setback, height and coverage requirements of the R-1 District.
