A RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF
SAN RAFAEL TO SIGN ON BEHALF OF THE CITY OF SAN RAFAEL
AND THE EAST SAN RAFAEL DRAINAGE ASSESSMENT DISTRICT
NO. 1 A DISCLAIMER OF INTEREST IN CO~WENSATION IN THE
LAWSUIT ENTITLED "CENTRAL r-m.RIN SANITATION AGENCY VS.
FRED GRANGE, ET AL"
WHEREAS, the City of San Rafael pursuant to the Hunicipal
Improvement Act of 1913 created the East San Rafael Drainage Assess~
ment District No. 1 and levied special assessments against the property
contained within the boundaries of that assessment district; and
WHEREAS, the Central Marin Sanitation Agency has filed an
eminent domain lawsuit entitled "Central Marin Sanitation Agency vs.
Fred Grange, et al", Marin Superior Court No. 110775, to condemn
certain property rights for property located within the boundaries of
that Assessment District; and
WHEREAS, the City of San Rafael on behalf of the City and
the Assessment District has been named as a defendant in the above-
entitled lawsuit; and
WHEREAS, it is the opinion of the Bond Counsel for the
Assessment District and the City staff and the bond holders' security
would not be impaired by the taking of the property rights in the
above-entitled lawsuit and for that reason the Assessment District
would not be entitled to any compensation; and
WHEREAS, based upon their recommendation, it is the desire
of this City Council to disclaim any intrest in compensation in the
above-entitled lawsuit.
NOW, THEREFORE, BE IT RESOLVED that the ~1ayor on behalf
of the City of San Rafael and the East San Rafael Drainage Assessment
District No. 1 is authorized to sign a Disclaimer of Interest in
Compensation and any related papers in the above-entitled lawsuit.
