HomeMy WebLinkAboutResolution No. 6525 (Video Outpost Public Nuisance)RESOLUTION NO. 6525 --'--'----"---- A RESOLUTION OF THE SAN RAFAEL CITY COUNCIL DECLARING THE "VIDEO OUTPOST" A PUBLIC NUISANCE AND ORDERING ABATEMENT OF SAME WHEREAS, Jack Carlson and Wendell Brown were notified that the video games, known as Video Outpost, being operated outside Colonial Liquors, situated in the City of San Rafael, State of California, known and designated as 1015 Tamalpias Avenue, more particularly described as Marin County Assessor's Parcel #11-27-03, constitute a public nuisance; and WHEREAS, Jack Carlson, owner of the Video Outpost, and Wendell Brown, owner of the Colonial Liquor Store, caused the Video Outpost to be placed on the premises at 1015 Tamalpais Avenue; and WHEREAS, the placement of the Video Outpost violates the Downtown Review District and C-2 Zoning Municipal Code Sections 14.44.010, and 14.66.010; and WHEREAS, violations of Title 14 of the San Rafael Municipal Code are declared to be public nuisances subject to abatement in Section 1.12.010;and WHEREAS, pursuant to Section 1.16.050 of the San Rafael Municipal Code, a public hearing was duly held before the City Council of the City of San Rafael on April 18, 1983; and WHEREAS, at said hearing the City Coucil considered all oral and written evidence presented; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Rafael, pursuant to Section 1.16.050, does hereby declare that a public nuisance exists on said premises and that there is sufficient cause to abate same; BE IT FURTHER RESOLVED that Jack Carlson, having charge or control of said video games, shall abate such nuisance by complete removal; BE IT FURTHER RESOLVED that if Jack Carlson, having charge or control of said video games, fails to abate said public nuisance by April 22, 1983, the City shall abate same by removal of the video games, as authorized in Section 1.16.070, and the cost of said abatement may be recovered by the public or private sale of the video games. - 1 - -,.
