HomeMy WebLinkAboutResolution No. 6535 (Below Market Rate Housing)RESOLUTION NO. 6535 A RESOLUTION OF THE SAN RAFAEL CITY COUNCIL REPLACING THE EXISTING HOUSING ELEMENT ACTION PROGRAM C11 WITH A NEW ACTION PROGRAM WHEREAS, the City Council has reviewed the Housing Element Annual Report; and WHEREAS, the report indicated that only a small number of inclusionary units had been required since adoption of the Housing Element; and WHEREAS, the Housing Element contains a policy encourag- ing developers to provide affordable and accessible units in all residential projects; and WHEREAS, the corresponding implementing program C11 states only that an inclusionary study would be prepared within a year and that the existing voluntary inclusionary program would continue to be implemented; and WHEREAS, the success of inclusionary programs could not be analyzed because of stagnant housing market conditions; and WHEREAS, the City Council is concerned that all developers be approached equally regarding the provision of below market rate units in larger housing projects; and WHEREAS, the City Council concludes that it is the intent of the City to negotiate and provide incentive for the inclusion of below market rate units affordable to persons of low and/or moderate income in all projects over ten units. NOW, THEREFORE, BE IT RESOLVED that the City Council deletes the existing Housing Element Action Program C11 and replaces it with a more positive below market rate program as follows: "Below Market Rate Housing: The City shall negotiate and provide incentives for BMR units affordable to persons of low and/or moderate income in all residential projects of 10 or more units. Such incentives may include density bonuses, modifi- cations to certain development standards and fees, and other measures found appropriate by the City."
