RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
RELATING TO A TIE VOTE OCCURRING IN A CITY OFFICE IN
THE SAN RAFAEL GENERAL MUNICIPAL ELECTION
WHEREAS, Section 20501 of the California Elections Code
provides that a procedure shall be established prior to the conduct
of a General Municipal Election to be employed in case of a tie
vote,
NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of San Rafael shall, in the case of a tie vote for a City office
in the San Rafael General Municipal Election which makes it impossible
to determine which of two or more candidates have been elected to
said City office, determine the winner by lot; and that the City
Council shall notify the candidates who have received the tie vote
to appear before it, at a time and place designated by the City
Council; and that the City Council shall, at that time and place
determine the winner or winners by lot.
BE IT FURTHER RESOLVED, that the aforementioned procedure
shall apply to the election of all City officers for said City of
San Rafael at the November 8, 1983 General Municipal Election and
all subsequent elections of such officers until said regulations
are revoked or amended.

Council of said City held on the fifth day of July
