A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL, MARIN COUNTY, CALIFORNIA, INITIATING
PROCEEDINGS FOR THE CIVIC CENTER NORTH
REORGANIZATION
WHEREAS, a proposal for a reorganization involving the
annexation of certain territory to the City of San Rafael has been
filed with the Local Agency Formation Commission; and
WHEREAS, this proposal was made in the form of a
petition filed by the First National State Bank of New Jersey; and
WHEREAS, the proposed "Civic Center North Reorganization"
involves those properties described in Exhibit "A"; and
WHEREAS, the territory proposed to be annexed is
uninhabited; and
WHEREAS, the annexation is needed because primary access
to the site is through the City; municipal services can be pro-
vided effectively and economically by the City; annexation assures
new development in conformance with the City's Northgate Activity
Center Plan; and the annexation is needed to provide sanitary
sewer service; and
WHEREAS, LAFCO has reviewed and approved the annexation
subject to the following conditions:
1. In the event that pursuant to rules, regulations or
ordinances of Las Gallinas Valley Sanitary District, as now or
hereafter amended, said District shall require any payment of a
fixed or determinable amount of money, either as a lump sum or in
installments; for the acquisition, transfer, use or right of use
of all or any part of the existing property, real or personal of
said District, such payment will be made to said District in the
manner and at the time as provided by the rules and regulations or
ordinances of said District, as now or hereafter amended.
2. Upon and after the effective date of the annexation
of territory to Las Gallinas Valley Sanitary District, all inhab-
itants within such territory, and all persons entitled to vote by
reason of residing or owning land within the territory, shall be
subject to the jurisdiction of said District; shall have the same
rights and duties as if the territory had been a part of said
District upon its original formation; shall be liable for the

payment of principal, interest, and any other amounts which shall
become due on account of any outstanding or then authorized but
thereafter issued bonds, including r e venue bonds, or other contracts
or obligations of said District; shall be subject to the levying
or fixing and collection of any and all taxes, assessments,
service charges, rentals or rates as may be necessary to provide
for such payment; and shall be subject to all of the rates, rules,
regulations, and ordinances of said District.
3. The applicant shall apply to the Local Agency Form-
ation Commission for adjustment to County Service Area No. 6 prior
to filing the final map for the Civic Center North developm e nt;
and
WHEREAS, the City, acting as conducting authority, is
required to hold a public hearing to consider the annexation.
NOW, THEREFORE, BE IT RESOLVED that:
a) A public hearing on this item shall be scheduled
for Monday, August 15, 1983 at 8:00 PM in the City Council Chambers,
1400 Fifth Avenue, San Rafael, California; and
b) Any interested person desiring to make written
protest against said annexation or detachment shall do so by
written communication filed with the clerk of the conducting
district not later than the hour set for hearing. A written
protest by a landowner shall contain a description sufficient to
identify the land owned by him; a protest by a voter shall contain
the residential address of such voter.
