RESOLUTION ORDERING CLOSING, ABANDONING AND
VACATING 10' WIDE PEDESTRIAN WAY AND PUBLIC
UTILITIES EASEMENT, MAP OF LAS COLINDAS UNIT
FIVE, SAN RAFAEL, CALIFORNIA
(Between 516 & 524 Heather Way)
WHEREAS, the City Council of the City of San Rafael on the
19th day of September, 1983, adopted Resolution No. 6642 entitled,
"RESOLUTION OF INTENTION TO VACATE 10' WIDE PEDESTRIAN WAY AND PUBLIC
UTILITIES EASEMENT - LAS COLINDAS UNIT FIVE SUBDIVISION, SAN RAFAEL,
CALIFORNIA"; and
WHEREAS, said Resolution was posted as required by law; and
WHEREAS, the Department of Public Works of the City of San
Rafael, California, conspicuously posted notices of easement vacation
as required by law; and
WHEREAS, a hearing was had this day as required by law and
said Resolution No. 6642, at which hearing the Council of the City of
San Rafael heard evidence offered by persons interested; and
WHEREAS, it appears from all of the evidence submitted that
the following described pedestrian way and.public utilities easement is
unnecessary for present or prospective public use;
NOW, THEREFORE, IT IS HEREBY RESOLVED as follows:
1. That the following described pedestrian way and public
utilities easement is unnecessary for present or prospective public use;
2. That the following described pedestrian way and public
utilities easement is hereby ordered closed, abandoned and vacated;
3. That the pedestrian way and public utilities easement
closed, abandoned and vacated is described on Exhibit "A" which is
attached hereto and incorporated herein by reference.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby
certify that the foregoing Resolution was duly and regularly introduced
and adopted at a regular meeting of the Council of the City of San
Rafael held on the 17th day of October, 1983, by the following vote,
to wit:
AYES: COUNCILMEMBERS:Breiner, Frugoli, Jensen, Miskimen & Mayor Mulryan
NOES: COUNCILMEMBERS:None
ABSENT: COUNCILMEMBERS:None

EXHIBIT "A"
DESCRIPTION OF 10' WIDE
PEDESTRIAN WAY AND PUBLIC
UTILITIES EASEMENT TO BE
ABANDONED
All that certain real property situate in the City of San Rafael,
County of Marin, State of California, described as follows:
BEGINNING at a point on the Northeasterly line of Heather Way,
at the most Northerly corner of Lot 154, as shown upon that certain
map entitled, "Map of Las Colindas Unit Five", filed for record
September 19, 1955 in Volume 8 of Maps, at page 90, Marin County
Records, running thence along said street North 32050' East 10.0
feet, thence leaving said line and running South 57010' East 100.0
feet, thence South 32050' West 10.0 feet to the most Easterly corner
of said Lot 154, thence along said lot line North 57010' West 100.0
feet to the point of beginning.
RESERVED, however, to Pacific Gas and Electric Company 20 feet along
said public utilities easement from the easterly line of Heather Way
to maintain, repair or reconstruct an anchor and down guy currently
occupying said portion of said easement.
