HomeMy WebLinkAboutResolution No. 6667 (Appeal Northgate Dr and Las Gallinas)RESOLUTION NO. 6667 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL UPHOLDING AN APPEAL OF THE PLANNING COMMISSION'S DENIAL OF ED82-79 (Northgate Dr. & Las Gallinas Ave.) WHEREAS, the applicant, Wolff-Sesnon-Buttery, has requested City approval to develop a 54,000 square foot office building on AP 175-360-05 at Northgate Drive and Las Gallinas Avenue; and WHEREAS, the San Rafael Planning Commission on October 11, 1983, considered a detailed staff report and presen- tation by the applicant and failed on a 3-3 vote (Starkweather, Willms & Livingston dissenting; Boro absent) to approve the project as recommended by staff; and WHEREAS, Joseph L. Lemon on behalf of said applicant filed a letter dated October 131, 1983, appealing the Planning Commission's effective denial of ED82-79; and WHEREAS, the San Rafael City Council on November 7, 1983, held a duly noticed public hearing to hear the appeal of the matter and considered the staff report dated November 2, 1983, and all testimony presented at the hearing. NOW, THEREFORE, BE IT RESOLVED that the San Rafael City Council upholds the applicant's appeal and certifies the Northgate Activity Center Plan EIR as the environmental review document for ED82-79 and approves ED82-79 subject to conditions (a) through (rr) on pages 9-11 of the aforementioned November 2, 1983 City Council staff report with the following finding: 1. The Northgate Activity Center Plan EIR adequately assesses all impacts associated with ED82-79, and the project as conditioned complies with the mitigation requirements of the Northgate Activity Center Plan in that the project does not exceed the Plan's PM peak period trip allocation for the site and the developer will contribute the project's fair share proportional cost of areawide transportation improvements; and 2. The project design is compatible with other urban offices such as the Holiday Plaza, 950 Northgate Drive and Commerce Clearing House buildings in that it will tie those urban forms together and better define the western edge of the urban core of the Northgate Activity Center Plan; and A RESOLUTION NO. 66L. 3. The project design meets the criteria for approval of environmental design review applications as detailed by ex- tensive staff and Design Review Board consideration of the project which led to substantial redesign of the original submittal resulting in a project which would have an architecturally well- defined surface to provide visual relief for near and middle range views to the site while presenting an urban form from longer range views consistent with surrounding urban building forms.
