A RESOLUTION DECLARING THE PUBLIC INTEREST REQUIRES
DISPENSING WITH THE FORAL COMPETITIVE BID PROCESS
FOR THE REPAIR OF A PORTION OF THE CITY OF SAN RAFAEL'S
LEVEE IN THE VICINITY OF THE EAST SAN RAFAEL DRAINAGE
ASSESSMENT DISTRICT NO. 2 POND
WHEREAS, this Council has reviewed the report of the Public
Works Director recommending that the City dispense with the formal
competitive bid process, relying instead upon an informal process,
to provide for the repair of a portion of the City's levee in the
vicinity of the East San Rafael Drainage Assessment District No. 2
Pond prior to the arrival of the projected high tides in December of
this year.
WHEREAS, if the City follows its formal competitive bid process,
the high tides would arrive before the contract could be awarded and
the portion of the City's levee here discussed would be inundated,
undermining that portion of the levee and resulting in damage to public
property. The cost of the levee repair after the high tides would
greatly exceed the present cost to repair the levee here discussed.
NOW, THEREFORE, BE IT RESOLVED that this Council determines
that the public interest and necessity demand the immediate expenditure
of public money to safeguard the publicly owned levee in the vicinity
of the East San Rafael Drainage Assessment District No. 2 Pond.
BE IT FURTHER RESOLVED that the City Manager is authorized to
execute on behalf of the City a contract for the repair of the levee
described in the Public Works Director's report dated November 15, 1983,
to the lowest bidder after calling for informal bids consistent with
that report.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly intro-
duced and adopted at a special meeting of the Council of said
City on Tuesday , the fifteenth day of
November 1983, by the following vote, to wit:
