A RESOLUTION AUTHORIZING THE SIGNING OF A
CONTRACT, LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf of
the City of San Rafael, a contract, lease or agreement with
BAHIA DE RAFAEL HOMEOWNERS ASSOCIATION (HOLD HARMLESS AGREEMENT)
a copy of which is hereby attached and by this reference made a part hereof.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced
and adopted at a regular meeting of the City Council of said City held
on Monday the 1st day of November '
1982, by the following vote, to wit:

This Agreement made this 1st day of
November

by and between the City of San Rafael and the Bahia de Rafael Property
Owner's Association is made subject to the following
Premises
WHEREAS, the Bahia de Rafael Property Owner's Association,
owner of certain real property known as the Common Area of Bahia
de Rafael Unit 2, San Rafael, State of California and described
in the County of Marin Assessor's Map Book 9, page 25, as shown in
attached Exhibit A, has granted to the City of San Rafael an easement
for public recreational uses of three par course stations,
NOW THEREFORE, it is agreed as follows:
The City of San Rafael shall hold harmless and indemnify
the Bahia de Rafael Property Owner's Association against all claims,
causes of action and similar assertions lodged, filed or levied against
the Bahia de Rafael Property Owner's Association by any person or entity
for personal or property damages occasioned and caused by public
recreational use of the above described easement. Indemnification
shall include, but not be limited to defense costs of legal representa-
tion and verdicts or awards of damages against the Bahia de Rafael
Property Owner's Association.
