A RESOLUTION AUTHORIZING THE SIGNING OF A
CONTRACT, LEASE OR AGREEMENT
(Eight Acres of Hillside Above Irwin Street)
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on
behalf of the City of San Rafael a contract, lease or agreement
with Bill Howard and Jim Hutson - property owners, a copy of
which is hereby attached and by this reference made a part
hereof.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael,
hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said
City on Monday_, the 15th day of November 1982, by the
following vote, to wit:

MUTUAL AGREEMENT TO EXTEND TIME LIMITS
FOR PROJECT PROCESSING PURSUANT TO
GOVERNMENT CODE SECTION 65957
WITNESSETH:
WHEREAS, Bill Howard/Jim Hutson (applicants and
property owners herein) have submitted applications to the
City of San Rafael (City herein) for processing of a
development project in East San Rafael (project herein); and
WHEREAS, pursuant to Government Code Section 65950,
the City "shall approve or disapprove such project within one
year from the date on which an application requesting approval
of such project has been received and accepted as complete by
such "agency"; and
WHEREAS, pursuant to Government Code Section 65957,
the time limit referenced in Section 65950 "may be extended
for a period not to exceed ninety days upon consent of the
public agency and the applicant"; and
WHEREAS, both parties herein desire the maximum time
available for processing of the application; and
WHEREAS, in order to guarantee that the ninety -day
time limit extension is granted automatically if all permit
approval or disapproval has not been rendered by the City at
the end of legal time limits, December 3, 1982.
BOTH PARTIES AGREE that if on December 3, 1982 all
permit approval or disapproval has not been rendered by the
City for the subdivision, the time limit shall automatically be
extended ninety days, commencing December 3, 1982.
