A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SAN RAFAEL AUTHORIZING EMERGENCY REPAIRS
TO STORM DRAIN AND AUTHORIZING WAIVER OF
PUBLIC BIDDING REQUIREMENTS (MOUNTAIN VIEW AVE.
PROPERTY)
WHEREAS, a storm drainage system located on certain
private properties at Mountain View Avenue, within the City of
San Rafael, has deteriorated and now has exceeded its useful life;
and
WHEREAS, the City of San Rafael and those affected
property owners have mutually agreed it shall be beneficial for
the preservation of those affected property owners' private
property interests to effect improvements and repairs to said
storm drain as set forth in an agreement executed between the City
and property owners; and
WHEREAS, in order to effect said repairs it is neces-
sary for the City and property owners to proceed immediately
before further winter rains; and
WHEREAS, certain parts of said repairs to the affected
storm drain constitute emergency work which must be performed
before the onset of further winter rains; and
WHEREAS, while cleaning and reaming of said storm drain
shall be accomplished forthwith, the actual repairs cannot be
performed presently, but at a time when weather permits; and
WHEREAS, said emergency work may avoid consequences of
such disastrous storms as were visited upon the Mountain View
area January 4, 1982; and
WHEREAS, in order to accomplish the cleaning work, it
is necessary for City to select forthwith a local contractor who
is able to perform said work based upon its past performance in
the City of San Rafael, its general reputation in the industry,
its availability and general ability to perform the type of work
necessary; and
WHEREAS, such selection is not amenable to a bidding
procedure whereby bids are solicited and advertised and opened
in a public bid opening.

NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of San Rafael that the emergency storm drain cleaning to
be performed in certain properties located on Mountain View
Avenue, City of San Rafael, shall be performed by a contractor
selected by the City of San Rafael rather than through a public
bidding procedure.
BE IT FURTHER RESOLVED, that the cleaning and reaming
shall be performed forthwith but that the actual repairs shall be
performed when weather permits, based upon the judgment of the
City Engineer, and shall be performed pursuant to the regular bid
procedures.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a special meeting of the Council of said
City on Monday , the 22nd day of November 1982, by the
following vote, to wit:
