A RESOLUTION AUTHORIZING THE SIGNING OF A
CONTRACT, LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows:
The MAYOR and CITY CLERK are authorized to execute, on behalf of
the City of San Rafael, a contract, lease or agreement with
BRIAN WITTENKELLER FOR LANDSCAPE ARCHITECTURAL SERVICES
a copy of which is hereby attached and by this reference made a
part hereof.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced
and adopted at a regular meeting of the City Council of said City held
on Monday the 3rd day of May, 1982, by the following vote, to wit:

AGREEMENT FOR LANDSCAPE ARCHITECTURAL SERVICES
THIS AGREEMENT, made and entered into this third day of
May , 1982, by and between the City of San
Rafael, a municipal corporation of the State of California, herein-
after called "City", and Brian Wittenkeller, hereinafter called
"Landscape Architect" witnesseth:
RECITALS
City desires to employ the services of said Landscape
Architect for preparation of a Conceptual Master Plan for a 7 -acre
neighborhood park in Peacock Gap.

1. General:
City engages Landscape Architect to furnish the services
hereinafter mentioned, at and for the compensation herein stipulated,
and Landscape Architect accepts said engagement upon said terms.
2. Work Tasks of Landscape Architect:
Landscape Architect shall.
a. Base Map Preparation: The consultant will compile
base map information provided by adjacent owners
and prepare a final base map at 1" = 20', with 2'
contour interval.
b. Data Gathering and Review: The consultant will
gather all available and applicable information
regarding the site. Information sources will
include the City of San Rafael, adjacent landowners,
various utility companies and other sources as
appropriate. The information will be reviewed and
analyzed and prepared in written summary. The
Landscape Architect will consider existing and proposed
land uses in the vicinity of the park and other plan-
ning guidelines including the Peacock Gap Neighbor-
hood Plan, proposed developments, Peacock Gap Golf
Course Plan and related documents.
C. Neighborhood Park Need Analysis: The Landscape
Architect will aid the City in the preparation of
a questionnaire. The Landscape Architect will prepare
the questionnaire and analyze the results.

d. Preparation of Conceptual Plan and Cost Estimate:
Based on the information compiled through the previous
tasks, the consultant will prepare two or three con-
ceptual plan alternatives. Each plan alternative will
be presented schematically on a map suitable for public
review, and each alternative will have a corresponding
cost estimate. The plans, as well as the cost
estimates, will reflect the need to phase the actual
construction of the park facilities based on the pro-
jected available funding by the City as shown below.

30% development within 3-5 years
20% development within 5-8 years
10% development within 8-10 years
e. Plan Review and Revision: The consultant will
present plans to the community a minimum of four
times. The meetings will be held in the Peacock Gap
Community, and residents will be encouraged to attend
and make recommendations regarding the park planning
alternatives. Based on the input at the community
meetings the consultant will consolidate the various
alternative plans into a single draft master plan
that will have a corresponding cost estimate and
will be developed to reflect project phasing based
on available funding.
Three or four public meetings will be held before
the City of San Rafael Park and Recreation Commission,
Planning Commission and City Council. Any changes
requested at these public meetings will be incorporated
into the plan and cost estimate.
The Landscape Architect will prepare a master plan
exhibit map and a cost estimate reflecting changes
as necessary.
Final product will include 2 graphic maps and booklet
summarizing planning process with renderings.

f. Final Review and Revision: The Landscape Architect
will be available for presentation of the final
master plan to the City Planning Commission and
City Council and will make necessary revisions
as requested by these bodies for their final
approval.
3. Data and Services to be Provided by City:
a. The City will mail questionnaire and compile results.
b. The City will provide any maps or engineering
information that they have available.

The above costs assume: `
a. Any subsurface or flood control engineering deemed
necessary by the City during the planning phase is
not included as a part of this contract;
b. Consultant will attend eight public meetings;
C. The above costs include all professional, secretarial
and graphic services required to complete the work as
outlined above; incidental costs such as travel and
out-of-pocket expenses are included in the above -
quoted costs;
d. Should the City desire to expand the scope of services
beyond that outlined, the consultant's rates of com-
pensation are as follows:
1) Principal at $45.00/Hr.
2) Graphics Technician at $25.00/Hr.
3) Secretarial at $16.00/Hr.

5. Payments by City:
City shall pay the Landscape Architect in accordance with
the stated compensation. The maximum fee for the services rendered will
be $12,400. Landscape Architect will submit invoices monthly, as work is
completed. In the event that the project area now planned is added to or
if there is change in program after the planning work has begun, the
maximum fee for the services shall be adjusted upwards as mutually agreed
upon between City and Landscape Architect.
6. Schedule of Landscape Architect's Services:
Landscape Architect's services shall begin immediately upon
receipt of the executed Agreement and Work Task Authorization, and shall
be completed within 180 days.
7. Termination:
City may at its sole discretion terminate this Agreement by
written notice delivered personally or mailed to Landscape Architect.
In the event of such termination, Landscape Architect shall forthwith
discontinue further services. Landscape Architect shall be paid all
sums due to him at termination, and the reasonable value of services
then due and rendered up to the time of termination.
In the event of termination, Landscape Architect shall turn
over to the City one copy of any and all studies, sketches, drawings,
computations, whether compiled or in the course of preparation, as the
permanent property of City.

8. Non -Assignment:
This Agreement shall not be assignable by either City or

Agreement in triplicate the day and year first -above written.
