RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
ORDER ABATEMENT OF PUBLIC NUISANCE
(229 Humboldt Street)
WHEREAS, Billy J. Taylor and Bonnie Gast were notified
that a carport on the premises which they own, situated in the
City of San Rafael, State of California, known and designated
as 229 Humboldt Street, and more particularly described as
Marin County Assessor's Parcel No. 010-061-17 constitutes a
public nuisance; and
WHEREAS, pursuant to Section 1.20.090 of the San
Rafael Municipal Code a hearing was duly held before the City
Council of the City of San Rafael; and
WHEREAS, said hearing was held on June 7, 1982, and
after considering the oral and written evidence presented the
Council determined that:
BILLY J. TAYLOR and BONNIE GAST have constructed a
carport on their property at 229 Humboldt Street, San Rafael,
within the required front setback in violation of San Rafael
Municipal Code Section 14.75.050(b) and without having
obtained the required building permits, a violation of San
Rafael Municipal Code Section 12.12.010; and,
WHEREAS, violations of Title 14 of the San Rafael
Municipal Code are declared to be public nuisances/in subject
to abatement in Section 14.96.020.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of San Rafael, pursuant to Section 1.20.110 does
hereby declare that a public nuisance exists on said premises
and that there is sufficient cause to abate same.
BE IT FURTHER RESOLVED that the owners, having charge
or control of said premises, shall abate such nuisance by
complete removal of the carport.

BE IT FURTHER RESOLVED that this order shall be
stayed if the owners herein make formal application for a
variance under the provisions of Title 14 of the San Rafael
Municipal Code within ten (10) days of receipt of a copy of
this resolution.
BE IT FURTHER RESOLVED that if the owners herein
shall not make such formal application for a variance, they
shall complete abatement of the carport within ten (10) days
of receipt of a copy of this resolution. In the event the
owners of said premises do not abate said public nuisance
within the time specified, the City shall abate same by
removal of the carport, as authorized in Section 1.20.130.

San Rafael, hereby certify that the foregoing resolution was duly
and regularly introduced and adopted at a regular meeting of the
Council of said City on Monday, the 21st day of June , 1982,
by the following vote, to wit:
