HomeMy WebLinkAboutResolution No. 6366 (JPA re Revenues from Local Gas Tax)RESOLUTION NO. 6366 A RESOLUTION AUTHORIZING THE SIGNING OF A CONTRACT, LEASE OR AGREEMENT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows: The MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San Rafael, a contract, lease or agreement with County of Marin - Joint Powers Agreement re Allocation of Revenues, Local Gas Tax Initiative - 30 per Gallon a copy of which is hereby attached and by this reference made a part hereof. LEONCINI, City Clerk AGREEMENT ALLOCATION OF REVENUES - LOCAL GAS TAX INITIATIVE THIS AGREEMENT, made and entered into this day of , 1982, by and between the COUNTY OF MARIN, hereinafter referred to as "County", and the incorporated CITIES OF MARIN: Belvedere, Corte Madera, Fairfax, Larkspur, Mill Valley, Novato, San Anse lmo, San Rafael, Sausalito, Ross, and Tiburon, hereinafter referred to as "Cities", all of the State of California. WITNESSETH: WHEREAS, County and the Cities desire to exercise the powers conferred upon them by California law in order to allocate and effect distribution of certain revenues generated through application of a 3� per gallon local gas tax initiative; and WHEREAS, such local gas tax initiative is provided for in Division 2, Part 4, commencing with Section 9501 of the Revenue and Taxation Code; and WHEREAS, such tax, as approved by the required number of voters, will provide in excess of $3 million per year to the County and the Cities for the purposes of road maintenance and reconstruction; and that amount; WHEREAS, an annual shortfall of maintenance funding exists in excess of THEREFORE, THE PARTIES AGREE: 1. The funds from revenue generated by passage of the local gas tax initiative will be allocated as follows: ten percent (10%) of the total shall be distributed equally to each of the parties to this agreement. The remainder shall be allocated to County and Cities in accordance with the gas tax formula, as amended, contained in the Streets and Highways Code. 2. The projects to be funded by these additional taxes shall be subject to review and recommendation of the existing Urban Thoroughfare Committee prior to final expenditure by each governing board. 3. County agrees that it will continue the present level of optional funds for the County Road Fund. 4. County agrees that seventy-five percent (75%) of the funding available to County from these additional taxes will be allocated to projects in the city - centered corridor as defined in the County -Wide General Plan. 5. The State Board of Equalization shall adopt the necessary rules and regulations to administer the tax and shall transmit the net revenues to County and Cities periodically in accordance with this allocation agreement.
