A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL DIRECTING STAFF TO FILE A NOTICE OF
MERGER ON CERTAIN REAL PROPERTY AT 262 ALPINE
STREET (AP 10-052-02 & 10-061-31)
WHEREAS, on August 3, 1982, the owner of the subject
property was sent by registered mail a Notice of Intention to
Record a Notice of Merger on the above -noted property; and
WHEREAS, this Notice of Intent identified a City Council
meeting date of September 7, 1982, in which this item would be
scheduled and reviewed by the City Council; and
WHEREAS, the City Council has determined that the above
noted property is subject to merger under Section 15.10.010 of
the City of San Rafael Municipal Code because of the following
reasons:
a. The subject property consists of two contiguous
parcels in common ownership, and at least one of them does not
conform to the slope standards of the Subdivision Ordinance (10,000
square feet minimum lot size for 20% slope);
b. One of these parcels is not developed with a building
for which a permit has been issued by the City; and
WHEREAS, the City Council has found the site to have
limited development potential because of inadequate access.
NOW, THEREFORE, BE IT RESOLVED that the San Rafael
City Council identifies a lot merger on the subject property and
directs staff to file a Notice of Merger legally merging County
Assessor's parcel numbers 10-052-02 and 10-061-31 in accordance
with Section 15.10.020 of the San Rafael Subdivision Ordinance.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a regular meeting of the Council of said
