RESOLUTION OF THE SAN RAFAEL CITY COUNCIL REQUESTING THAT
THE COUNTY OF MARIN REQUIRE THAT TRAFFIC MITIGATION FEES
BE PAID BY NEW DEVELOPMENT IN THE UNINCORPORATED AREAS WHOSE
TRAFFIC WILL IMPACT ROADS IN THE NORTHGATE ACTIVITY AREA.
WHEREAS, the City Council authorized the preparation of the Northgate Activity
Center Plan and Final Environmental impact report; and
WHEREAS, as part of those studies, a comprehensive analysis of traffic impact
at various intersections was included; and
WHEREAS, as a result of the traffic analysis, certain capital improvement
projects were identified as being necessary in order to mitigate traffic impacts due
to additional development in the Northgate area; and
WHEREAS, the City of San Rafael has certified that the Final Environmental
Impact Report for the Northgate Activity Center Plan completely, correctly and
adequately describes proposed development, potential adverse effects, available
mitigation measures, public comments and responses; and
WHEREAS, the City of San Rafael has adopted the Northgate Activity Center Plan
which requires that new development contribute to the payment for necessary traffic
improvements; and
WHEREAS, certain of the additional development in the Northgate area is
located within the unincorporated area; and
WHEREAS, the City seeks equitable treatment of new development generating
traffic which will affect the Northgate Activity Center.
NOW, THEREFORE, BE IT RESOLVED that the City of San Rafael requests that the
County of Marin coordinate its development review processes so that equitable traffic
improvements fees are levied on both City and County development projects which
contribute traffic to the Northgate Activity Center.
